Cattaraugus County court report


Lori Pettit Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County Court on Monday, April 23, 2012:

     OBIDAH RAMADHAN, d/o/b 03/11/1986, of Olean, New York, but presently incarcerated in the Cattaraugus County Jail, was sentenced to a determinate term of five years incarceration with the NYS Department of Corrections.  Additionally, he will be subject to a term of two years supervision once he is released from prison.  He was convicted of Attempted Criminal Sale of a Controlled Substance in the Third Degree, a class C felony.  On January 1, 2011, in the City of Olean, he knowingly and unlawfully attempted to sell a narcotic drug, to wit, cocaine. 

     FREDERICK WEAVER, d/o/b 09/08/1936, of Leon, New York, was sentenced to a term of incarceration having a minimum of one and one-third years and a maximum of four years with the NYS Department of Corrections, restitution and assessed a mandatory State surcharge for his conviction of Grand Larceny in the Fourth Degree, a class E felony.  The incident occurred between January 1, 2008 and February 3, 2011, when he stole property in excess of one thousand dollars.

     CHRISTOPHER WINSHIP, d/o/b 9/16/1984, of Olean, New York, was sentenced to a determinate one and one-half year term of incarceration with the NYS Department of Corrections.  Additionally, he will be subject to a one year term of supervision once he is released from prison.  He was convicted of Attempted Criminal Sale of a Controlled Substance in the Fifth Degree, a class E felony. The incident occurred on or about April 21, 2010, in the City of Olean, when the defendant knowingly and unlawfully attempted to sell a narcotic drug

     TIMOTHY M. HOPKINS, d/o/b 05/17/1960, of Salamanca, New York, was sentenced to 5 years probation to include 240 hours of community service, $1,000.00 fine, his license is revoked for one year and he was assessed a mandatory State surcharge for his conviction of Aggravated Driving While Intoxicated, a class E felony.  The incident occurred on or about May 30, 2011, in the City of Salamanca, when he operated a motor vehicle in an intoxicated condition, having a BAC of .25%.
    

     ADELE M. FLORES, d/o/b 10/26/1978, of Olean, New York, was sentenced to five years probation, her driver's license was suspended for six months and she was assessed a mandatory State surcharge for her conviction of Attempted Criminal Possession of a Controlled Substance in the Third Degree, a class C felony, to satisfy a pending indictment.  The incident occurred on or about June 30, 2011, in the City of Salamanca, when the defendant knowing and unlawfully attempted to possess a narcotic drug, to wit crack cocaine.

     BARRY K. ARMPRESTER, d/o/b 02/09/1967, of Olean, New York, was sentenced to five years probation and assessed a mandatory State surcharge for his conviction of to Criminal Possession of a Controlled Substance in the Fifth Degree, a class D felony. On or about March 24, 2011, in the City of Olean, Armprester knowingly and unlawfully possessed a controlled substance, to wit, Dihydrocodeinone with Acetaminophen, with intent to sell it.

     TIMOTHY J. HAMMOND, d/o/b 06/04/1984, of Cuba, New York, was sentenced to five years probation to include 240 hours of community service, $1,000.00 fine, his driver's license was revoked for 18 months and he was assessed a mandatory State surcharge for his conviction of Driving While Intoxicated, a class E felony.  On October 8, 2011, in the City of Olean, he operated a motor vehicle on a public highway in an intoxicated condition, having a .15 BAC.  

     DAVID BREMILLER, d/o/b 12/20/1974, of East Otto, New York, was sentenced to five years probation, his driver's license was suspended for six months and he was assessed a mandatory State surcharge for his conviction of Attempted Criminal Sale of a Controlled Substance in the Third Degree, a class C felony.  The incident occurred on or about January 20, 2011, in the City of Olean, when the defendant knowing and unlawfully attempted to sell a narcotic drug, to wit crack cocaine.

     VLADIMIR J. RYMKO, d/o/b 9/10/1963, of Farmington, Michigan, but presently incarcerated in the Cattaraugus County  Jail, was sentenced to a term of one year in the Cattaraugus County Jail, a $2,000.00 fine, his driver's license was revoked for one year and he was assessed a mandatory State surcharge for his conviction of Driving While Intoxicated, a class D felony.  The incident occurred on or about November 8, 2011, in the City of Olean, the defendant operated a motor vehicle in an intoxicated condition, having a .18% BAC.


     BRANDI N. OSBY, d/o/b 9/15/1979, of Allegany, New York, entered a plea of guilty to Welfare Fraud in the Fourth Degree, a class E felony, to satisfy a pending indictment.  The indictment charges that between August 2005 and July 2009, in the City of Olean, the defendant committed a fraudulent welfare act and thereby took or obtained public assistance benefits in excess of $1,000.  She will be sentenced on July 15, 2012.

     BRADLEY J. CLARK, d/o/b 12/27/1968, of Bolivar, New York, was sentenced to 5 years probation to include 240 hours of community service, a fine of $1,500.00, his driver's license was revoked, and assessed a mandatory State surcharge for his convictions of Driving While Intoxicated, a class E felony and Aggravated Unlicensed Operation in the Second Degree, a class A misdemeanor. The incident occurred on or about December 16, 2009, in the City of Olean, when he operated a motor vehicle on a public highway at a time when his BAC .17%.

     SUZANNE E. BARNISH, d/o/b 03/13/1965, of Allegany, New York, was sentenced to 5 years probation to include 240 hours of community service, a fine of $1,500.00, her driver's license was revoked for one year and assessed a mandatory State surcharge for her convictions of Aggravated Driving While Intoxicated, a class E felony, and Aggravated Unlicensed Operation of a Motor Vehicle in the Second Degree, a misdemeanor.  On or about September 24, 2011, in the City of Olean, Barnish operated a motor vehicle on a public highway in an intoxicated condition having a .25 BAC and without a valid driver's license due to a prior alcohol conviction.     

     JUSTIN WALKER, d/o/b 07/19/1991, of Hinsdale, New York, was sentenced to 5 years probation, his driver's license was suspended for six months, ordered to pay restitution and assessed a mandatory State surcharge for his conviction of Criminal Sale of a Controlled Substance in the Fifth Degree, a class D felony. The incident occurred on or about November 17, 2010, in the City of Olean, when he knowingly and unlawfully sold a narcotic drug, to wit, crack cocaine.

     JOSEPH R. HOFFMAN, d/o/b 06/11/1981, of Delevan, New York, was sentenced to 5 years probation to include 50 hours of community service, a $2,000.00 fine, license revocation and assessed a mandatory State surcharge for his conviction of Driving While Intoxicated, a class D felony.  The incident occurred on or about April 18, 2010, in the Town of Yorkshire, when the defendant operated a motor vehicle in an intoxicated condition.

     JAMES M. HOVEY, d/o/b 07/19/1988, of Olean, New York, entered a plea of guilty to two counts of Assault in the Third Degree, class A misdemeanors, to satisfy a pending indictment. The incident occurred on or about October 24, 2011 and October 29, 2011, in the City of Olean, when the defendant, with intent, cause physical injury to another person, he caused such injury to such person.  He will be sentenced on July 16, 2012.

     THOMAS J. WASHINGTON, d/o/b 10/19/1988, of Olean, NY, was arraigned and entered a plea of not guilty in connection to an indictment handed up by a Cattaraugus County Grand Jury which charged him with two counts of Attempted Robbery in the Second Degree, class D felonies, and Assault in the Third Degree, a class A misdemeanor.  The Indictment charged that on or about February 10, 2012, in the City of Olean, while acting jointly and in concert with another and each aiding and abetting each other, attempted for forcibly steal property and caused physical injury to a person who was not a participant in the crime.  This matter is adjourned 45 days for motions.

     JAMES M. SCHICHTEL, d/o/b 11/8/1958, of West Valley, NY, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Driving While Intoxicated, a class E felony.  On November 13, 2011, in the Town of Ashford, he operated a motor vehicle in an intoxicated condition, having a BAC of .18 percent.  He will be sentenced on July 16, 2012.

     DAVID A. ROMERO, III, d/o/b 11/13/1981, of Salamanca, NY, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Aggravated Unlicensed Operation of a Motor Vehicle in the First Degree, a class E felony, and Driving While Intoxicated, a misdemeanor.  On December 27, 2011, in the City of Salamanca, he operated a motor vehicle in an intoxicated condition, having a BAC of .09 percent, and without a valid driver's license due to a previous alcohol related conviction.  He will be sentenced on July 16, 2012.

     LUIS A. CASTELLANO, d/o/b 3/26/1980, of Salamanca, NY, was arraigned and entered a plea of not guilty in connection with an indictment handed up by a Cattaraugus County Grand Jury which charged him with two counts of Driving While Intoxicated, class E felonies, and Unsafe Lane Change, a violation.  The Indictment charged that on or about October 29, 2011, in the City of Olean, he operated a motor vehicle in an intoxicated condition, having a BAC of .12 percent and made an unsafe lane change.  This matter has been adjourned 45 days for motions.



     CRYSTAL L. FOWLER, d/o/b 8/1/1983, of Salamanca, NY, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to one count of Driving While Intoxicated, a class E felony.  On September 11, 2011, in the City of Salamanca, she operated a motor vehicle in an intoxicated condition, having a BAC of .18 percent.  She will be sentenced on July 16, 2012.

     SPENCER D. GOLDEN, d/o/b 6/14/1980, of Allegany, NY, but presently incarcerated in the Cattaraugus County Jail, was arraigned and entered a plea of not guilty in connection with an indictment handed up by a Cattaraugus County Grand Jury which charged him with Sexual Abuse in the First Degree, a class D felony; Unlawful Imprisonment in the Second Degree, a class E felony, and Forcible Touching, a class A misdemeanor.  The Indictment charged that on or about February 26, 2012, in the City of Olean, he subjected a person to sexual contact by forcible compulsion, restrained said person under circumstances which exposed the person to a risk of serious physical injury and intentionally forcibly touched the sexual or other intimate parts of the person for the purpose of degrading or abusing such or for the purpose of gratifying the actor's sexual desire.  This matter has been adjourned 45 days for motions.

     LAURIE A. GREKULAK, d/o/b 12/12/1976, of Perrysburg, NY, was arraigned and entered a plea of not guilty in connection with an indictment handed up by a Cattaraugus County Grand Jury which charged her with Aggravated Driving While Intoxicated With a Child, a class E felony; two counts of Driving While Intoxicated, misdemeanors, and No Stopping/Standing on Highway, a violation.  The Indictment charged that on or about October 22, 2011, in the Town of Perrysburg, she operated a motor vehicle in an intoxicated condition, having a BAC of .12 percent, and with a child under the age of fifteen years of age who was a passenger in the vehicle.   This matter was adjourned 45 days for motions.
