Allegany County man indicted on rape and other charges
Brendon Warren of Fillmore was indicted on charges of Rape 1st, Strangulation 2nd and Sexual Misconduct.. Prosecutors allege that Warren forcibly engaged in sexual intercourse with another person and choked the person to a near black-out stage. They say he also disabled a cell phone. The crime alleges that the incident happened last December in the town of Hume.

Irving Smith-Friendship, Allegany County-admits to selling drugs to undercover agent
An Allegany County man will spend the next five years on probation after he reached a plea deal with prosecutors. In court this morning, 48-year old Irving Smith of West Water Street in Friendship pleaded guilty to a single count of criminal sale of marihuana. He had been charged in an indictment with multiple felony counts of selling marihuana and sale and possession of a controlled substance. Allegany County DA Keith Slep tells WVTT news radio that in 20-10…on multiple occasions, Smith sold drugs to an undercover Task Force officer. In addition to probation, Slep said Judge Thomas Brown ordered Smith to pay fines, fees and court surcharges.

Bolivar man sentenced
A Bolivar man will spend the next year on probation. 22-year old Gordon Ordiway accepted a plea deal to the charge of felony DWI. Ordiway was arrested last June for driving erratically in Bolivar. In Allegany County court, Judge Terrance Parker sentenced his to the interim probation term and ordered him back in court next year.

Allegany County man fails drug court---sent to prison
An Allegany County man has been ordered to state prison. According to District Attorney Keith Slep, 46-year old Johnny Bernal of Times Square, Friendship had been facing felony counts of DWI. He was ordered into drug court, but prosecutors say he failed that. Thursday, Judge Thomas Brown sentenced him to consecutive prison terms of one to three years. Prosecutors said it began with his first DWI arrest May 2, 2010 in Wellsville.

Former Alfred State student sent to prison
A former Alfred State College student was sent to prison Monday. Twenty-one year old Spencer Daniels of Rochester was sentenced to 3 1/2 years in state prison for his guilty plea to felony Burglary. Daniels admitted to Judge Terry Parker that in May he and others stole computer and other property from dorm rooms from fellow students. In addition, prosecutors said the young man must also serve five years post release supervision.
Olean man gets probation for selling drugs
An Olean man was sentenced today to five years probation for selling drugs in Allegany County. The sentence was handed down for thirty-three year old Ronald Miller of Martin Street, Olean. He pleaded guilty today to Criminal Sale of a Controlled Substance. District Attorney Kieth Slep said Miller admitted to Judge Terry Parker that he sold drugs to an undercover officer...once in Angelica and again in Wellsville. A Grand Jury had indicted him on felony counts of both possessing and selling a controlled substance and marijuana. In addition, Miller was ordered to pay $250.

Wellsvillle man who choked woman gets state prison term
A Wellsville man is headed to state prison. 43-year old David Green of 200 Merriam Heights pleaded guilty to Felony Assault in Allegany County court Thursday. Prosecutors said Green choked a woman until she was unconscious. The crime happened nearly a year ago in the Town of Independence. In addition, Green will serve five years post release supervision. Originally, Green had been charged with Assault-2nd, Menacing and Criminal Obstruction of Breathing.

Allegany County man drives through State Police road block - sent to state prison
An Allegany County man was sent to prison this morning. 31-year old Mitchel Hinckley, 7272 East Hill Road, Caneadea, admitted in court that on September 3rd, he committed a felony by accelerating his car, speeding through a stationary DWI road check on state route 243...narrowly missing several Troopers standing there. Hinckly, a registered sex offender, was on probation at the time for his 2009 conviction for failing to register his address with the state. Judge Thomas Brown sentenced the man to 2-4 years for Reckless Endangerment and 1 1/3-4 years for Violating Probation...the sentences to run concurrently. No troopers were injured in the September incident. Originally, Hinckley had been charged with Felony Reckless Endangerment, Reckless Driving and Unlawfully fleeing a police officer in a motor vehicle.
Allegany County woman admits welfare fraud
In Allegany County court this morning, facing a felony and five misdemeanors, a 23-year old woman took a plea deal. Kim Sherlock, 4105 Irons Road, Scio was sentenced to one year conditional discharge for Welfare Fraud. Prosecutors said she failed to disclose her total income while receiving food stamps. As a result, she received $452 in food stamps she was not entitled to. Sherlock has been originally charged with Offering a False Instrument for Filing, felony and five counts of misdemeanor Welfare Fraud.

Allegany County Grand Jury indicts two men
An Allegany County Grand Jury has handed up indictments against two men. 30-year old Thomas O’Brien of Alma was indicted for Felony Attempted Rape, Unlawful imprisonment and Forcible Touching. Prosecutors say O’Brien tried to forcible have sex with another person. It allegedly happened in May in Friendship.
42-year old Christian R. Gaylord of friendship was indicted on charges of Felony Rape and Endangering the Welfare of a Child. The crimes allegedly happened more than two years ago in Friendship when Gaylord is accused of having sexual intercourse with a person under the age of 17. Both men await arraignments in county court.

Allegany County man admits selling drugs to a child
From the Allegany County courthouse…22-year old Steven Rhodes of Clarksville pleaded guilty this morning to misdemeanor Endangering the Welfare of a child. He’ll be sentenced in February 8, 2012. Prosecutors say he had faced multiple serious felonies to include Criminal Sale of a Controlled Substance to a Child (B-Felony) and Criminal Sale of Marijuana. The crime was committed May 29, 2010 in Clarksville when Rhodes sold Hydrocodone to a child. He was indicted by a Grand Jury September 8, 2010. Last year in Clarksville, Rhodes admitted he sold Hydrocodone to a child.

Allegany County woman takes plea deal in welfare fraud case
In Allegany County, a Friendship woman accepted a plea deal in county court Monday. 33-year old Kristin Voss of Maple Grove Road pleaded guilty to misdemeanor Welfare Fraud. She had faced seven felonies. Judge Thomas Brown sentenced Voss to three years probation and ordered to pay back $8,000 in food stamps and $5200 in other benefits. Prosecutors said the fraud spanned a three year period.

Allegany County man sent to jail in strangulation case
An Allegany County man will spend a year in jail after he admitted he attempted to strangle a woman in June. 39-year old Christopher Swain of Fillmore was sentenced yesterday in court. It all stems from a violent incident with a woman in the Town of Granger.

Portville man pleads guilty to Grand Larceny
A Portville man pleaded guilty to Grand Larceny this morning in Allegany County Court. Twenty-seven year old Dustin Bilby was released from jail on reduced bail and will be sentenced December 6th. Bilby accepted a plea deal before the Honorable Terrance Parker. Bilby had faced 24 counts of Forgery as well as burglary, possessing stolen property, and grand larceny. Prosecutors said Bilby stole a check book and in a separate crime broke into a beauty salon and stole products and cash...both incidents occurred in Friendship in April and August.
