Cattaraugus County court report

    Lori Pettit Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County Court on Monday, February 9, 2012:

    
MATT W. SHIELDS, d/o/b 06/07/1982, of Randolph, New York, was sentenced to 5 years probation; 240 hours of community service; New York State  Drivers License Revoked and a fine of $1000.00 for his conviction of Driving While Intoxicated, a class E felony.  The incident occurred on or about February 24, 2011 in the Town of Randolph, when the defendant operated a motor vehicle on a public highway at a time when he had a .17% BAC.

NATHAN C. BIEHL, d/o/b 9/27/1984, of Delevan, New York, was sentenced to 5 years probation on each count of the indictment to run concurrent for his conviction of Reckless Endangerment in the First Degree, a class D felony; and Attempted Criminal Possession of a Weapon in the Third Degree, a class E felony.  The incident occurred on or about June 22, 2011, in the Town of Yorkshire, when the defendant acted jointly and in concert with another and each aiding an abetting the other, under circumstances evincing a depraved indifference to human life, recklessly  engaged in conduct which created grave risk of death to another person and possessed a loaded firearm.

     SAMANTHA CONNER, d/o/b 05/23/1990, of Bradford, P.A., was sentenced to 1 year Conditional Discharge for her conviction of Criminal Possession of a Controlled Substance in the Seventh Degree, a class A misdemeanor.  The incident occurred on or about December 22, 2010, in the City of Olean, when the defendant knowingly and unlawfully possessed a controlled substance with the intent to sell it.

      

DAVON DUNBAR, d/o/b 09/14/1991, of Buffalo, New York, but presently incarcerated in the Cattaraugus County Jail, entered a plea of guilty to Attempted Criminal Possession of a Controlled Substance in the Third Degree, class C felony, to satisfy a pending indictment.  The incident occurred on or about March 20, 2010, in the City of Olean, when he attempted to possess a narcotic drug with the intent to sell it.

MILENA SHERWOOD, d/o/b 10/02/1983, of Great Valley, was sentenced to 5 years probation and ordered to pay restitution for her conviction of Attempted Criminal Possession of a Controlled Substance in the Fifth Degree (E felony).  The incident occurred on or about October 23, 2010, in the City of Olean, when the defendant attempted to possess Hydrocodone. 


GLENN E.REYNOLDS, d/o/b 05/23/1962, of Randolph, entered a plea of guilty to Aggravated Driving While Intoxicated, a class E felony and Aggravated Unlicensed Operation in the Second Degree, a class A misdemeanor.  The incident occurred on or about October 27, 2011, in the Town of Coldspring, when the defendant operated a motor vehicle on a public highway and when he know or had reason to know that his license or privilege of operating a motor vehicle in New York State was suspended or revoked. Sentencing is scheduled for May 14, 2012.


MAX REYES, d/o/b 02/07/1971, of Olean, was sentenced to 1 year conditional discharge, a fine of $100.00 and to register with the New York State Sex Offender Registry within 90 days for his conviction of Attempted Failure to Register as a Sex Offender with New York State, a class E felony. The incident occurred on or about February 7, 2011, in the Town of Allegany, when the defendant failed to register with the Division of Criminal Justice Services no later than 10 calendar days after any change of address.


BARBARA J. REDEYE, d/o/b 10/17/1992, of Steamburg, New York, was sentenced to 5 years probation, a $1,000.00 fine, New York State Drivers License Revoked for 6 months and Mandatory State Surcharges for her conviction to Aggravated Driving While Intoxicated with a Child Passenger, a class E felony.  The incident occurred on or about August 13, 2011, in the City of Salamanca, when the defendant operated a motor vehicle on a public highway at a time when she was in an intoxicated condition and while a child who was fifteen years of age or less was a passenger in such motor vehicle.  


ERICA L. NIVER, d/o/b 07/16/1979, of Olean, New York, was sentenced to five (5) years probation; $1,000.00 fine and her Drivers License Revoked for her conviction of Driving While Ability Impaired by Drugs, class E felony and for her conviction of Aggravated Unlicensed Operation in the Second Degree, a class A misdemeanor, she was sentence to 3 years probation to run concurrent and a $500.00 fine.  The incident occurred on or about May 17, 2011, in the City of Olean, the defendant operated a motor vehicle on a public highway at a time when her ability to operate such a motor vehicle was impaired by the use of drugs and when she know or had reason to know that her license or privilege of operating a motor vehicle in New York State was suspended or revoked.
