Cattaraugus County court report

    Lori Pettit Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County Court on Monday, February 6, 2012:

    
     TRAVIS J. PENROD, d/o/b 01/10/1976, of Hinsdale, New York, was arraigned and entered a plea of not guilty in connection with an indictment handed up by a Cattaraugus County Grand Jury which charged him with one count of Aggravated Driving While Intoxicated, a class E felony; two counts of Driving While Intoxicated (VTL §1192 (2)(3)), class E felonies; one count of Failure to Keep Right, a violation and two counts of Moved from Lane Unsafely, violations.  The Indictment charged that on or about July 17, 2011 in the Town of New Albion, the defendant operated a motor vehicle on a public highway at a time when he had a .19% BAC. This matter has been adjourned 45 days for motions.

ANDREW G. SWAN d/o/b 04/29/1956, of Salamanca , New York, was sentenced to five years probation; 100 hours of community service; license revoked and a fine of $2000.00 in connection to an indictment handed up by a Cattaraugus County which charged him with Aggravated Driving While Intoxicated, a class E felony.   The Indictment charged that on or about January 1, 2010, Andrew G. Swan operated a motor vehicle on a public highway at a time when he had .18 of one per centum or more by weight of alcohol in his blood; specifically he had a BAC .20%.


            JEREMY M. FOSTER, d/o/b 4/18/1990, of Salamanca, New York, was arraigned and entered a plea of guilty in connection to an indictment handed up by a Cattaraugus County Grand Jury which charged him with one count of Resisting Arrest, a class A misdemeanor. The Indictment charged that on or about November 13, 2011 in the City of Salamanca, the defendant intentionally prevented or attempted to prevent a police officer from effecting an authorized arrest of himself. Sentencing is scheduled for April 9, 2012.
