Cattaraugus County District Attorney news

  
Lori Pettit Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County Court on Monday, April 16, 2012:

     JOSHUA P. TYLER, d/o/b 11/4/1985, of Olean, New York, was arraigned and entered pleas of not guilty to two separate indictments.  The first Indictment charges him with Burglary in the Second Degree, a class C felony; and Criminal Possession of Stolen Property in the Fifth Degree, a class A misdemeanor.  The incident occurred on or about November 23, 2011, in the Town of Hinsdale, when the defendant knowingly entered or remained unlawfully in a building with intent to commit a crime therein and possessed stolen property.  The second Indictment charges him with Assault in the Second Degree, a class D felony; and Resisting Arrest, a class A misdemeanor.  The incident occurred on or about February 9, 2012, in the City of Olean, when the defendant, while resisting arrest, caused injury to a police officer.  Both cases have been adjourned for motions.

     NICHOLAS K. SCOTT, d/o/b 12/8/1977, of Salamanca, New York, was arraigned and entered a plea of not guilty to an Indictment that charges him with two counts of Driving While Intoxicated, class E felonies; Failure to Keep Right and Unsafe Turn, both violations.  The incident occurred on or about October 8, 2011, in the City of Salamanca, when the defendant operated a motor vehicle in an intoxicated condition, having a .12% BAC.  The matter has been adjourned for motions.

     DESHAWN J. FRANCE, d/o/b 5/29/1990, of Olean, New York, and QUWHYN R. NOBLES, d/o/b 1/21/1995, of Olean, New York, were arraigned and entered pleas of not guilty to an Indictment that charges them with Burglary in the Third Degree, a class D felony; and Petit Larceny, a class A misdemeanor.  The incident occurred on or about June 28, 2011, in the Town of Portville, when the defendants, acting jointly, knowingly entered or remained unlawfully in a building with intent to commit a crime therein and stole property.  The cases have been adjourned for motions.

     MICHAEL L. CHASE, d/o/b 11/5/1990, of Olean, New York, but presently incarcerated in the Cattaraugus County Jail waived prosecution by Indictment and entered a plea of guilty by Superior Court Information to Burglary in the Third Degree, a class D felony.  The incident occurred on or about January 28, 2012, in the City of Olean, when the defendant knowingly entered or remained unlawfully in a building with intent to commit a crime therein.  Sentencing is scheduled for July 9, 2012.

     TRAVIS L. PERKINS, d/o/b 1/3/1971, of Silver Creek, New York, waived prosecution by Indictment and entered a plea of guilty by Superior Court Information to Aggravated Driving While Intoxicated, a class E felony.  The incident occurred on or about January 2, 2012, in the City of Salamanca, when the defendant operated a motor vehicle in an intoxicated condition, having a .26% BAC.  Sentencing is scheduled for August 27, 2012.

     TANYA M. BREHM, d/o/b 6/16/1993, of Machias, New York, waived prosecution by Indictment and entered a plea of guilty by Superior Court Information to Attempted Burglary in the Third Degree, a class E felony.  The incident occurred on or about January 27, 2012, in the Town of Machias, when the defendant knowingly attempted to enter or remain unlawfully in a building with intent to commit a crime therein.  Sentencing is scheduled for July 9, 2012.

     MARY C. MCCONNELL, d/o/b 6/1/1988, of Olean, New York, waived prosecution by Indictment and entered a plea of guilty by Superior Court Information to Attempted Burglary in the Third Degree, a class E felony.  The incident occurred on or about September 30, 2011, in the Town of Olean, when the defendant knowingly attempted to enter or remain unlawfully in a building with intent to commit a crime therein.  Sentencing is scheduled for July 9, 2012.

     DONALD WILLIAMS, d/o/b 11/17/1988, address unknown, entered a plea of guilty to Criminal Possession of a Controlled Substance in the Seventh Degree, a class A misdemeanor, to satisfy a pending indictment.  The incident occurred on or about November 4, 2010, in the City of Olean, when the defendant knowingly and unlawfully possessed a controlled substance.  Sentencing is scheduled for July 16, 2012.

     JAMES E. BARAN, d/o/b 1/21/75, of Jamestown, New York, was sentenced to a term of 1-3 years in the New York State Department of Corrections for his conviction of Burglary in the Third Degree, a class D felony; and a concurrent term of one year for his conviction of Criminal Mischief in the Fourth Degree, a class A misdemeanor.  He was also ordered to pay restitution in the amount of $1,394.69  The incident occurred on or about December 15, 2011, in the Town of South Valley, when the defendant, acting jointly with others, knowingly entered or remained unlawfully in a building with intent to commit a crime therein and intentionally damaged property.
