Cattaraugus County District Attorney Court Report


    Lori Pettit Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County Court on Monday, January 23, 2012:

     LEO E. STROMECKI, d/o/b 02/13/1993, of Franklinville, New York, but presently incarcerated in the Cattaraugus County Jail, was sentenced to a determinate term of five (5) years in the New York State Department of Corrections to be followed by a ten (10) year term of post-release supervision for his conviction of Rape in the Second Degree, a class C felony.  The incident occurred on or about May 21, 2011, in the Town of Farmersville, when the defendant, being eighteen years old or more, engaged in sexual intercourse with another person who was less than thirteen years old.

DAKOTA MIX, d/o/b 3/7/1992, of Franklinville, New York, was sentenced to a determinate term of 2 ½ years in the New York State Department of Corrections to be followed by one (1) year of post-release supervision for his conviction of Criminal Sale of a Controlled Substance in the Fifth Degree, a class D felony.  The incident occurred on or about December 17, 2010, in the City of Olean when the defendant acted jointly and in concert with another individual, knowingly and unlawfully sold crack cocaine. 

TRAVIS M. MABEE, d/o/b 1/26/1984, of Hinsdale, New York, and LYNDA N. RISHEL, d/o/b 10/1/1982, of Allegany, New York, were both sentenced to five (5) years probation for their convictions of Forgery in the Second, a class D felony; and Petit Larceny, a class A misdemeanor.  They were also ordered to pay restitution.  The incidents occurred on or about and between December 3, 2010 and January 4, 2011, in the Town of Allegany when the defendants acted jointly and in concert with another forged checks and stole property.

TRAVIS M. MABEE, d/o/b 1/26/1984, of Hinsdale, New York, was sentenced to five (5) years probation of his conviction of Attempted Criminal Sale of a Controlled Substance in the Fourth Degree, a class D felony.  The incident occurred on or about February 16, 2011, in the City of Olean, when the defendant attempted to sell Suboxin pills.



     BARRY E. SNYDER, III, d/o/ b 05/03/1980, of Salamanca, but presently incarcerated in the Cattaraugus County Jail, was sentenced to a term of one (1) to three (3) years in the New York State Department of Corrections for his conviction of Driving While Intoxicated, a class E felony, Aggravated Unlicensed Operation of a Motor Vehicle in the Second Degree, a misdemeanor, and Reckless Driving, a misdemeanor.  He was also fined $1,500 and his license was revoked.  On or about July 3, 2011, in the City of Salamanca, he operated a motor vehicle in an intoxicated condition, without a valid driver's license due to a prior alcohol related conviction and operated his motor vehicle in a reckless manner.  He was also sentenced to two concurrent one (1) year terms for violating the terms and conditions of two previously imposed sentences of probation.

     FREDERICK WEAVER, d/o/b 09/08/1936, of Leon, New York, was entered a plea of guilty to Grand Larceny in the Fourth Degree, a class E felony, to satisfy a pending indictment.  The incident occurred between January 1, 2008 and February 3, 2011, when he stole property in excess of one thousand dollars.  Sentencing is scheduled for April 23, 2012.

     TIMOTHY M. HOPKINS, d/o/b 05/17/1960, of Salamanca, New York, entered a plea of guilty to Aggravated Driving While Intoxicated, a class E felony, to satisfy a pending indictment.  The incident occurred on or about May 30, 2011, in the City of Salamanca, when he operated a motor vehicle in an intoxicated condition, having a BAC of .25%.  Sentencing is scheduled for April 23, 2012.

ADELE M. FLORES, d/o/b 10/26/1978, of Olean, New York, entered a plea of guilty to Attempted Criminal Possession of a Controlled Substance in the Third Degree, a class C felony, to satisfy a pending indictment.  The incident occurred on or about June 30, 2011, in the City of Salamanca, when the defendant knowing and unlawfully attempted to possess a narcotic drug, to wit crack cocaine.  Sentencing is scheduled for April 23, 2012.

LARRY M. PETERSON, d/o/b 12/28/1988, of Olean, New York, entered a plea of guilty to Attempted Criminal Sale of a Controlled Substance in the Third Degree, a class C felony, to satisfy a pending indictment.  The incident occurred on or about June 30, 2011, in the City of Salamanca, when the defendant knowing and unlawfully attempted to sell a narcotic drug, to wit crack cocaine.  Sentencing is scheduled for April 23, 2012.

     DAVID BREMILLER, d/o/b 12/20/1974, of East Otto, New York, entered a plea of guilty to Attempted Criminal Sale of a Controlled Substance in the Third Degree, a class C felony, to satisfy a pending indictment.  The incident occurred on or about January 20, 2011, in the City of Olean, when the defendant knowing and unlawfully attempted to sell a narcotic drug, to wit crack cocaine.  Sentencing is scheduled for April 23, 2012.

     JEFF A. BELLAMY, JR., d/o/b 1/14/1976, of Buffalo, New York, entered a plea of guilty to Criminal Possession of a Controlled Substance in the Fifth Degree, a class D felony; and Resisting Arrest, a class A misdemeanor, to satisfy a pending indictment.  The incident occurred on or about December 3, 2010, in the City of Olean, when the defendant, following a traffic stop, was found to be in possession of more than 1/8 of an ounce of cocaine.  Sentencing is scheduled for May 7, 2012.

     VLADIMIR J. RYMKO, d/o/b 9/10/1963, of Farmington, Michigan, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Driving While Intoxicated, a class D felony.  The incident occurred on or about November 8, 2011, in the City of Olean, the defendant operated a motor vehicle in an intoxicated condition, having a .18% BAC.  Sentencing is scheduled for April 23, 2012.

     HARLEY D. ZARNOCH, d/o/b 4/16/1995, of Gowanda, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Burglary in the Third Degree, a class D felony.  The incident occurred on or about September 15, 2011 in the Town of Persia, when the defendant knowingly entered or remained unlawfully in a building with intent to commit a crime therein.  Sentencing is scheduled for March 26, 2012.

     BRANDI N. OSBY, d/o/b 9/15/1979, of Allegany, New York, was arraigned and entered a plea of not guilty to an indictment that charges her with Grand Larceny in the Third Degree, a class D felony; Welfare Fraud in the Third Degree, a class D felony; and Offering a False Instrument for Filing in the First Degree, a class E felony.  The indictment charges that between August 2005 and July 2009, in the City of Olean, the defendant committed a fraudulent welfare act and thereby took or obtained public assistance benefits in excess of $3,000.  The matter has been adjourned for motions.

     DANIEL P. KLEIN, d/o/b 8/6/1989, of Olean, New York, but presently incarcerated in the Cattaraugus County Jail, was arraigned and entered a plea of not guilty to an indictment that charges him with Assault in the Second Degree, a class  D felony; Robbery in the Third Degree, a class D felony; two counts of Menacing in the Second Degree, class A misdemeanors; Unlawful Possession of Marihuana, a violation; and Criminal Possession of a Controlled Substance in the Seventh Degree, a class A misdemeanor.  The indictment charges that on or about October 11, 2011, in the City of Olean, the defendant displayed a deadly weapon or dangerous instrument and forcibly stole property.  The indictment further charged that on or about October 12, 2012, in the City of Olean, the defendant, with intent to prevent a police officer from performing a lawful duty, caused physical injury to such police officer.

     ROBERT E. GILBERT, d/o/b 3/19/1980, of Olean, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with Forgery in the Second Degree, a class D felony; Identity Theft in the Second Degree, a class E felony; and Criminal Possession of Stolen Property in the Fourth Degree, a class E felony.  The indictment charges that on or about February 7, 2011, in the Town of Carollton, the defendant used a stolen credit card and forged the signature.  The matter has been adjourned for motions.

     CATLIN J. JACKSON, d/o/b 6/14/1984, of Salamanca, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with Assault in the Second Degree, a class D felony; Resisting Arrest, a class A misdemeanor; Reckless Driving, Obstructing Governmental Administration and Unlawful Fleeing a Police Officer, misdemeanors; and Drove Left of Pavement Markings, a violation.  The indictment charges that on or about July 15, 2011, in the City of Salamanca, the defendant, with intent to prevent a police officer from performing his lawful duty, caused physical injury to such police officer.  The matter has been adjourned for motions.

     CALEB M. NEELY, d/o/b 3/9/1990, of Olean, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with Criminal Possession of Marihuana in the Second Degree, a class D felony; Driving While Ability Impaired by Drugs, a class E felony; Drove Across Hazard Markings, Speed in Zone and Interfered With Safe Operation, violations.  The indictment charges that on or about May 17, 2011, in the Town of Machias, the defendant operated a motor vehicle under the influence of drugs and possessed more than 16 ounces of marihuana.  The matter has been adjourned for motions.
