Cattaraugus County court report

Lori Pettit Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County Court on Monday, January 9, 2012:
    
     JAMES R. BARIBEAU, d/o/b 06/11/1990, currently incarcerated in the Cattaraugus County Jail, entered a plea of guilty to two (2) counts Attempted Robbery in the First Degree, class C felonies, to satisfy two pending indictments.  The first incident occurred on September 23, 2008, in the City of Olean, while acting jointly and in concert with others and each aiding and abetting each other, he attempted to forcibly steal property and in the course of the commission of the crime or of immediate flight therefrom, displayed what appeared to be a pistol, revolver or other firearm.  The second incident occurred on October 9, 2008, in the Town of Allegany, while acting jointly and in concert with others and each aiding and abetting each other, he attempted to forcibly steal property and in the course of the commission of the crime or of immediate flight therefrom, displayed what appeared to be a pistol, revolver or other firearm.  He will be sentenced on March 12, 2012.   

     GARY MILLER, d/o/b 10/16/1953, of Salamanca, New York, was arraigned and entered a plea of not guilty in connection with an indictment handed up by a Cattaraugus County Grand Jury which charged him with Criminal Possession of a Controlled Substance in the Fifth Degree, a class D felony, and Criminal Sale of a Controlled Substance in the Fourth Degree, a class C felony.  The indictment charged that on or about October 21, 2010, in the City of Salamanca, the defendant knowingly and unlawfully sold a narcotic preparation and possessed a controlled substance with the intent to sell it.  This matter has been adjourned 45 days for motions.







    

     JASON W. ALEXANDER, d/o/b 09/10/1978, of Gowanda, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Attempted Criminal Mischief in the Fourth Degree, a class E felony.  On or about July 10, 2011, in the Town of Perrysburg, when knowing he had no right to do so nor any reasonable ground to believe that he had such right, attempted to intentionally damage property of another person.  He was sentenced to 45 days incarceration in the Cattaraugus County Jail and restitution.

     CHRISTOPHER LABARGE, d/o/b 10/08/1984, of Olean, New York, was sentenced to a term of five (5) years probation, restitution and his driver's license was suspended for one year for his conviction of Attempted Criminal Sale of a Controlled Substance in the Fourth Degree, a class D felony.  On January 14, 2011, in the City of Olean, he knowingly and unlawfully attempted to sell a narcotic preparation, to wit, Dihydrocodeinone with Acetaminophen.

     SANDRA PARENTE, d/o/b 4/4/1984, of Little Valley, New York, was sentenced to a term of five (5) years probation and her driver's license was suspended for six (6) months for her conviction of Attempted Criminal Sale of a Controlled Substance in the Fifth Degree, a class E felony, to satisfy a pending indictment.  The incident occurred on or about February 5, 2011, in the City of Olean, when she knowingly and unlawfully attempted to sell a controlled substance, to wit, Alprazolam.

     BRANDON M. BATCHA, d/o/b 03/25/1995, of Limestone, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to one count of Burglary in the Third Degree, a class D felony, and Aggravated Harassment in the Second Degree, a class A misdemeanor.  On August 12, 2011, in the Town of Carrollton, he knowingly entered or remained unlawfully in a building with intent to commit a crime therein. Additionally, on September 1, 2011, in the Town of Carrollton, he communicated with a person anonymously or otherwise, by telephone, by mail or by transmitting or delivering any other form of written communication in a manner likely to cause annoyance or alarm.  He will be sentenced on May 14, 2012.

     MICHAEL C. LATHROP, d/o/b 02/06/1991, of Delevan, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Attempted Robbery in the Third Degree, a class E felony.  On September 16, 2011, in the Town of Yorkshire, he attempted to forcibly steal property.  He will be sentenced on March 12, 2012.



     IRA S. EVANS, d/o/b 02/04/1970, of Olean, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Aggravated Driving While Intoxicated, a class E felony.  On November 6, 2011, in the City of Olean, he operated a motor vehicle in an intoxicated condition, having a BAC of .27 percent.  He will be sentenced on March 12, 2012.

     JACKIE L. CHAMBERLAIN, d/o/b 5/22/1968, of Cattaraugus, New York, was sentenced to a term of five (5) years probation, a $1,000.00 fine, license revocation and a mandatory State surcharge for her conviction of Aggravated  Driving While Intoxicated with a Child Passenger, a class E felony.  The incident occurred on or about May 22, 2011, in the Town of Ashford, when the defendant operated a motor vehicle on a public highway at a time when she was in an intoxicated condition, having a .15% BAC, and while a child who was fifteen years of age or less was a passenger in the motor vehicle.

     BARBARA K. DEXTER, d/o/b 02/07/1957, of Salamanca, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Attempted Burglary in the Third Degree, a class E felony.   On June 23, 2011, in the City of Salamanca, she knowingly attempted to enter or remain unlawfully in a building with intent to commit a crime therein.  She will be sentenced on May 14, 2012.

     LACY DAVIS, d/o/b 2/25/1990, of Olean, New York, was arraigned and entered a plea of not guilty in connection with two separate indictments.  The first indictment charged her with Criminal Possession of a Controlled Substance in the Fifth Degree, a class D felony, and Criminal Sale of a Controlled Substance in the Fourth Degree, a class C felony.  The Indictment charged that on or about November 4, 2010, in the City of Olean, while acting jointly and in concert with another, and each aiding and abetting each other, knowingly and unlawfully sold a narcotic preparation and possessed a controlled substance with the intent to sell it.  The second indictment charged her with Criminal Possession of a Controlled Substance in the Fifth Degree, a class D felony, and Criminal Sale of a Controlled Substance in the Fourth Degree, a class C felony.  The Indictment charged that on or about October 28, 2010, in the City of Olean, while acting jointly and in concert with another, and each aiding and abetting each other, knowingly and unlawfully sold a narcotic preparation and possessed a controlled substance with the intent to sell it.   Both cases have been adjourned 45 days for motions.



     TIMOTHY M. HOPKINS, d/o/b 05/17/1960, of Salamanca, New York, was arraigned and entered a plea of not guilty in connection with an indictment handed up by a Cattaraugus County Grand Jury which charged him with Aggravated Driving While Intoxicated, a class E felony; Driving While Intoxicated, a class E felony, and the vehicle and traffic violations of Moved From Lane Unsafely, Improper Left Turn and Illegal Signal.  The Indictment charged that on or about May 30, 2011, in the City of Salamanca, he operated a motor vehicle in an intoxicated condition, having a BAC of .25 percent, moved from lane unsafely, made an improper left turn and failed to use his turn signal.  This case has been adjourned 45 days for motions.
