Cattaraugus County court report


Lori Pettit Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County Court on Tuesday, January 3, 2012:



     RACHELLE N. BARTLETT, d/o/b 06/06/1989, of Delevan, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to one (1) count of Attempted Assault in the Second Degree, a class E felony. The incident occurred on or about and between September 8, 2011 and September 9, 2011, in the Town of Yorkshire, being eighteen years old or more and with intent caused physical injury to a person less than seven years old, she attempted to cause such injury to such person. She will be sentenced on March 12, 2012.


DESTINY M. BELLAUS, d/o/b 10/01/1968, of Olean, New York, was arraigned and entered a plea of not guilty to an indictment that charges her with one (1) count of Assault in the First Degree, a class C felony; one (1) count of Assault in the Second Degree, a class D felony and one (1) count of Criminal Possession of a Weapon in the Fourth Degree, a class A misdemeanor.  The incident occurred on or about November 4, 2011, in the City of Olean, when the defendant caused serious physical injury to another person,also she caused such injury to such person by means of a deadly weapon or a dangerous instrument. The matter has been adjourned for motions.




BRADLEY J. CLARK, d/o/b 12/27/1968, of Bolivar, New York, entered a plea of guilty to Driving While Intoxicated , a class E felony and Aggravated Unlicensed Operation in the Second Degree, a class A misdemeanor, to satisfy a pending indictment. The incident occurred on or about December 16, 2009, in the City of Olean, when he operated a motor vehicle on a public highway at a time when his BAC .17%.Sentencing is scheduled for April 23, 2012.




GARY C. COLEMAN, d/o/b 07/24/1989, of Olean, New York, but presently incarcerated in the Cattaraugus County Jail was sentenced to a term of 2½ years in the New York State Department of Corrections plus 1 year post-release supervision on each count, to be served concurrently, for his conviction of Criminal Possession of a Controlled Substance in the Third Degree, a class B felony; Criminal Sale of a Controlled Substance in the Third Degree, a class B felony; two counts of Criminal Sale of a Controlled Substance in the Fourth Degree, class C felonies; and two counts of Criminal Possession of a Controlled Substance in the Fifth Degree, class D felonies.  The indictment alleges that on or about December 8, 2010, in the City of Olean, the defendant possessed and sold crack cocaine and a controlled substance.  The indictment further alleges that on or about December 15, 2010, in the City of Olean, the defendant possessed and sold methadone. 


ADELE M. FLORES, d/o/b 10/26/1978, of Olean, New York, was arraigned and entered a plea of not guilty to an indictment that charges her with one (1) count of Criminal Possession of a Controlled Substance in the Third Degree, a class B felony; one (1) count of Unlawful Possession of Marijuana, a violation and one (1) count of Criminal Use of Drug Paraphernalia in the Second Degree, a class A misdemeanor. The incident occurred on or about June 30, 2011, in the City of Salamanca, when the defendant knowing and unlawfully possessed a narcotic drug with the intent to sell it, to wit crack cocaine. The matter has been adjourned for motions.

LARRY M. PETERSON, d/o/b 12/28/1988, of Olean, New York, was arraigned and entered a plea of not guilty to an indictment that charges her with two (2) counts of Criminal Possession of a Controlled Substance in the Third Degree, class B felonies; two (2) counts of Criminal Sale of a Controlled Substance in the Third Degree, class B felonies; one (1) count of Unlawful Possession of Marijuana, a violation and one (1) count of Criminal Use of Drug Paraphernalia in the Second Degree, a class A misdemeanor. The matter has been adjourned for motions.



ASHLEY WALKER, d/o/b 5/8/1986, of Olean, New York, was sentenced to  five (5) years probation and restitution for her conviction of Attempted Criminal Sale of a Controlled Substance in the third Degree, a class C felony, to satisfy a pending indictment.  The incident occurred on or about December 1, 2010, in the City of Olean, when the defendant knowingly and unlawfully attempted to sell a narcotic drug, to wit, fentanyl.

JAMES M. HOVEY, d/o/b 07/19/1988, of Olean, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with one (1) count of Assault in the Second Degree, a class D felony; one (1) count of Assault in the Third Degree, a class A misdemeanor and one (1) count of Harassment in the Second Degree, a violation. The incident occurred on or about October 24, 2011 and October 29, 2011, in the City of Olean, when the defendant, with intent, caused physical injury to another person, he caused such injury to another person by means of a deadly weapon or a dangerous instrument. The matter has been adjourned for motions.

TERRY SAGE, d/o/b 07/26/1993, of Franklinville, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with one (1) count of Burglary in the Third Degree, a class D felony; one (1) count of Criminal Mischief in the Second Degree, a class D felony; three (3) counts of Making Graffiti, class A misdemeanors and one (1) count of Petit Larceny, a class A misdemeanor. The incident occurred on or about May 8, 2011, in the Town of Franklinville, when the defendant acted jointly and in concert with others, aiding and abetting the other, knowingly entered and remained unlawfully in a building with the intent to commit a crime therein. The matter has been adjourned for motions.

CAMERON S. RIVES, d/o/b 11/11/1992, of Jamestown, New York, but presently incarcerated in the Cattaraugus County Jail was arraigned and entered a plea of not guilty to an indictment that charges him with one (1) count of Robbery in the First Degree, a class B felony; one (1) count of Robbery in the Second Degree, a class C felony; one (1) count of Burglary in the First Degree, a class B felony; one (1) count of Burglary in the Second Degree, a class C felony; one (1) count of Assault in the Third Degree, a class A misdemeanor and one (1) count of Petit Larceny, a class A misdemeanor. The incident occurred on or about November 10,2011, in the Town of Randolph, when the defendant acted jointly and in concert with others, forcibly stole property and when, in the course of the commission of the crime or of immediate flight therefrom, he or another participant in the crime displayed what appeared to be a pistol, revolver, rifle, shotgun, machine gun or other firearm  and each aiding and abetting the other, knowingly entered and remained unlawfully in a building with the intent to commit a crime therein. Bail was raised to $150,000.00 cash or $300,000.00 bond. The matter has been adjourned for motions.

WASHINGTON, d/o/b 07/07/1989, of Jamestown, New York, but presently incarcerated in the Cattaraugus County Jail was arraigned and entered a plea of not guilty to an indictment that charges him with one (1) count of Robbery in the First Degree, a class B felony; one (1) count of Robbery in the Second Degree, a class C felony; one (1) count of Burglary in the First Degree, a class B felony; one (1) count of Burglary in the Second Degree, a class C felony; one (1) count of Assault in the Third Degree, a class A misdemeanor and one (1) count of Petit Larceny, a class A misdemeanor. The incident occurred on or about November 10,2011, in the Town of Randolph, when the defendant acted jointly and in concert with each other, forcibly stole property and when, in the course of the commission of the crime or of immediate flight therefrom, he or another participant in the crime displayed what appeared to be a pistol, revolver, rifle, shotgun, machine gun or other firearm  and each aiding and abetting the other, knowingly entered and remained unlawfully in a building with the intent to commit a crime therein. The matter has been adjourned for motions and the defendant is being held without bail.

WILLIAMS, d/o/b 06/04/1990, of Jamestown, New York, but presently incarcerated in the Cattaraugus County Jail was arraigned and entered a plea of not guilty to an indictment that charges him with one (1) count of Robbery in the First Degree, a class B felony; one (1) count of Robbery in the Second Degree, a class C felony; one (1) count of Burglary in the First Degree, a class B felony; one (1) count of Burglary in the Second Degree, a class C felony; one (1) count of Assault in the Third Degree, a class A misdemeanor and one (1) count of Petit Larceny, a class A misdemeanor. The incident occurred on or about November 10,2011, in the Town of Randolph, when the defendant acted jointly and in concert with each other, forcibly stole property and when, in the course of the commission of the crime or of immediate flight therefrom, he or another participant in the crime displayed what appeared to be a pistol, revolver, rifle, shotgun, machine gun or other firearm  and each aiding and abetting the other, knowingly entered and remained unlawfully in a building with the intent to commit a crime therein. Bail is set for $100,000.00 cash and $200,000.00 bond. The matter has been adjourned for motions.

SAMUEL L. RODRIGUEZ, JR., d/o/b 06/29/1987, of Jamestown, New York, but presently incarcerated in the Cattaraugus County Jail was arraigned and entered a plea of not guilty to an indictment that charges him with one (1) count of Robbery in the First Degree, a class B felony; one (1) count of Robbery in the Second Degree, a class C felony; one (1) count of Burglary in the First Degree, a class B felony; one (1) count of Burglary in the Second Degree, a class C felony; one (1) count of Assault in the Third Degree, a class A misdemeanor and one (1) count of Petit Larceny, a class A misdemeanor. The incident occurred on or about November 10,2011, in the Town of Randolph, when the defendant acted jointly and in concert with each other, forcibly stole property and when, in the course of the commission of the crime or of immediate flight therefrom, he or another participant in the crime displayed what appeared to be a pistol, revolver, rifle, shotgun, machine gun or other firearm  and each aiding and abetting the other, knowingly entered and remained unlawfully in a building with the intent to commit a crime therein. The matter has been adjourned for motions and the defendant is being held without bail.



WAYNE IRVIN, d/o/b 05/28/1977, of Olean, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with one (1) count of Rape in the First Degree, a class B felony; one (1) count of Criminal Sexual Act in the First Degree, a class B felony; one (1) count of Sexual Abuse in the First Degree, a class D felony and one (1) count of Endangering the Welfare of a Child, a class A misdemeanor. The incident occurred on or about August 15, 2011, in the City of Olean, when the defendant engaged in sexual intercourse with another person less than eleven years of age. The matter has been adjourned for motions.


JESSE CONNER, d/o/b 05/27/1979, of Olean, New York, entered a plea of guilty to Attempted Criminal Sale of a Controlled Substance , a class C felony, to satisfy a pending indictment. The incident occurred on or about March 25, 2011, in the City of Olean, when the defendant knowingly and unlawfully sold a narcotic drug, to wit, cocaine. Sentencing is scheduled for March 12, 2012.








ERNEST E. BOYD, d/o/b 07/05/1973, of East Otto, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with one (1) count of Failure to Register with the New York State Sex Offender Registry, a class E felony. The incident occurred on or about and between January 2011 and March 2011 in the Town of East Otto, when the defendant failed to register with the Division of Criminal Justice Services no later than ten (10) calendar days after any change of address. The matter has been adjourned for motions.



JARRETT D. RICHARDSON, d/o/b 11/03/1993, of West Valley, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with one (1) count of  Burglary in the Second Degree, a class C felony. The incident occurred on or about May 28, 2011 in the Town of Great Valley, when the defendant knowingly entered or remained unlawfully in a dwelling with the intent to commit a crime therein. The matter has been adjourned for motions.

ALICIA M. TYGER, d/o/b 02/23/1984, of Salamanca, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with one (1) count of Criminal Sale of a Controlled Substance in the Third Degree, a class B felony; One (1) count of Criminal Possession of a Controlled Substance in the Third Degree, a class B felony. The incident occurred on or about December 21, 2010 in the City of Salamanca, when the defendant knowingly and unlawfully possessed and sold a narcotic drug, to wit, Oxycodone. The matter has been adjourned for motions.
