Cattaraugus County court report

   Lori Pettit Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County Court on Monday, December 19, 2011:

     NATHAN CLESTER, d/o/b 5/27/1988, presently incarcerated in the Cattaraugus County Jail after being extradited by the State of Florida, was arraigned and entered a plea of not guilty in connection with an indictment handed up by a Cattaraugus County Grand Jury which charged him with Robbery in the First Degree, a class B felony; two counts of Robbery in the Second Degree, class C felonies; Burglary in the First Degree, a class B felony; and Burglary in the Second Degree, a class C felony.  The Indictment charged that on or about September 5, 2009, in the Town of Farmersville, while acting jointly and in concert with others, the defendant forcibly stole property from a person who was not a participant in the crime and displayed what appeared to be a pistol, revolver or other firearm.  The defendant is in jail in lieu of $100,000 bail and the matter has been adjourned for motions.


FREDDIE PACE, d/o/b 12/12/1960, of Olean, New York, entered a plea of guilty to Attempted Criminal Sale of a Controlled Substance in the Fifth Degree, a class E felony, to satisfy a pending indictment. The incident occurred on or about April 22, 2011, in the City of Olean, when he knowingly and unlawfully attempted to sell Xanax pills.  Sentencing is scheduled for March 15, 2012.


   Lori Pettit Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County Court on Tuesday, December 20, 2011:



     DANIEL S. SMREK, d/o/b 05/04/1965, of Salamanca, New York, was sentenced to two consecutive terms of 2-6 years in the New York State Department of Corrections for his convictions of two counts of Driving While Intoxicated (class D felonies), and one count of Aggravated Unlicensed Operation of a Motor Vehicle in the Second Degree, a misdemeanor.  One incident occurred on March 3, 2011, in the Town of Great Valley, when the defendant operated a motor vehicle on a public highway at a time when he was in an intoxicated condition.  The second incident occurred on April 28, 2011, in the City of Salamanca, when the defendant operated a motor vehicle on a public highway at a time when he was in an intoxicated condition and without a valid driver's license because of a prior alcohol related offense.  The third incident occurred on May 7, 2011, in the City of Salamanca, when he operated a motor vehicle in an intoxicated condition.

     JESSE C. BARTLETT, JR., d/o/b 3/15/1990, of Olean, New York, was sentenced to a determine one year in the New York State Department of Corrections for his conviction of Attempted Criminal Sale of a Controlled Substance in the Fourth Degree, a class D felony.  The incident occurred on or about December 15, 2010, in the City of Olean, when the defendant attempted to sell Hydrocodone pills.

     BARBARA J. ROBINSON, d/o/b 10/24/1967, of Ellicottville, New York, was arraigned and entered a plea of not guilty to an indictment that charges her with Aggravated Driving While Intoxicated, a class E felony; Driving While Intoxicated, a class E felony; Failure to Keep Right and No Headlamps, both violations.  The incident occurred on or about May 12, 2011, in the Village of Ellicottville, when the defendant operated a motor vehicle in an intoxicated condition, having a .34% BAC.  The matter has been adjourned for motions.

RAYMOND A. TURNER, d/o/b 10/21/1979, of Salamanca, New York, was sentenced to five years probation for his conviction of Attempted Criminal Sale of a Controlled Substance in the Third Degree, a class C felony.  The incident occurred on or about September 25, 2009, in the City of Salamanca, when the defendant attempted to sell cocaine.
