Cattaraugus County District Attorney report

Lori Pettit Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County Court on Monday, October 3, 2011:

            DALE A. REDEYE, d/o/b 08/29/1979, of Salamanca , New York, was sentenced, as a Second Felony Offender, in connection with two separate cases.  For the first case he received a term of incarceration having a minimum of two years and a maximum of six years with the NYS Department of Corrections, his driver's license was revoked, he was fined $2,500.00 and assessed a mandatory State surcharge for his convictions of Driving While Intoxicated, a class D felony and Aggravated Unlicensed Operation in the Second Degree, a class A misdemeanor. On or about May 31, 2010, in the City of Olean, the defendant operated a motor vehicle in an intoxicated condition and without a valid driver's license due to a previous alcohol related conviction.   For the second case, he received a determinate term of two years with the NYS Department of Corrections for his conviction of Attempted Criminal Sale of a Controlled Substance in the Third Degree, a class C felony.  The incident occurred on or about September 2, 2009, in the City of Salamanca, when he knowingly and unlawfully sold crack cocaine.  This sentence will be served consecutively to his DWI conviction.  Additionally, once he is released from prison, he will be subject to a term of two years post release supervision.

            JAIRO S. CHAVEZ, d/o/b 9/4/86, of Albion, New York, entered a plea of guilty to one count of Burglary in the Third Degree, a class D felony, to satisfy a pending indictment.  On or about March 2, 2011, in the City of Olean, he knowingly entered or remained unlawfully in a building with the intent to commit a crime therein.  He will be sentenced on December 12, 2011.

          NICOLE R. FENNER, d/o/b 8/20/1971, of Delevan, New York, was sentenced to 5 years probation, her driver's license was revoked, she was fined a total of $1,000.00 and assessed a mandatory State surcharge for her conviction of Aggravated Driving While Intoxicated, a class E felony.  The incident occurred on or about February 6, 2011, in the Town of Machias, when the defendant operated a motor vehicle with a .20% BAC and with a child less than 15 years old in the vehicle. 



            KEVIN E. KRANOCK, d/o/b 6/19/1956, of Cuba, New York, was sentenced to 5 years probation, his driver's license was revoked, he was fined a total of $2,000.00 and assessed a mandatory State surcharge for his conviction of Driving While Intoxicated, a class E felony.  The incident occurred on or about April 3, 2010, in the Town of Portville, when the defendant operated a motor vehicle in an intoxicated condition, having a .16% BAC. 

            DANIEL PRICE, A/K/A BRICK, d/o/b 01/28/1985, of Olean, New York, but presently incarcerated in the Cattaraugus County Jail, entered a plea of guilty one count of Attempted Criminal Sale of a Controlled Substance in the Third Degree, a class C felony, to satisfy a pending indictment. The indictment charged that on or about October 22, 2010, in the City of Olean, he attempted to sell a controlled substance, to wit, crack cocaine.   He will be sentenced on December 12, 2011. 

            JESSE CONNER, d/0/b 05/27/1979, address unknown, was arraigned and entered a plea of not guilty in connection with an indictment handed up by a Cattaraugus County Grand Jury which charged him with Criminal Sale of a Controlled Substance in the Third Degree, Criminal Possession of a Controlled Substance in the Third Degree, and Criminal Sale of a Controlled Substance Near School Grounds.  The Indictment charged that on or about March 23, 2011, in the City of Olean, he knowingly and unlawfully possessed and sold a narcotic drug and did so on or about school grounds and/or school bus.  This matter has been adjourned 45 days for motions.

            DANIEL S. RICHTER, d/o/b 10/12/1969, of Olean, New York, but presently incarcerated in the Cattaraugus County Jail, was arraigned and entered a plea of not guilty in connection with an indictment handed up by a Cattaraugus County Grand Jury which charged him with Assault in the Second Degree, a class D felony.  The Indictment charged that on or about August 4, 2011, in the City of Olean, with intent to prevent a medical personnel from administering medical services as a medical personnel in a hospital emergency department, caused physical injury to that person.   This matter has been adjourned 45 days for motions.



            STEPHEN J. SCHINDLBECK, d/o/b 09/13/1985, of Olean, New York, was arraigned and entered a plea of not guilty in connection with an indictment handed up by a Cattaraugus County Grand Jury which charged him with Robbery in the First Degree, a class B felony; Criminal Possession of a Weapon in the Fourth Degree, a class A misdemeanor, and Petit Larceny, a class A misdemeanor.  The Indictment charged that on or about August 15, 2011, he forcibly stole property and in the course of the crime, he or another participant used or threatened the immediate use of a dangerous instrument, and stole property.  This matter was adjourned 45 days for motions.

            FREDERICK WEAVER, d/o/b 09/08/1936, of Leon, New York, was arraigned and entered a plea of not guilty in connection with an indictment handed up by a Cattaraugus County Grand Jury which charged him with Grand Larceny in the Third Degree, a class D felony, and Falsifying Business Records in the First Degree, a class E felony.  The Indictment charged that between January 1, 2008 and February 3, 2011, he stole property in excess of three thousand dollars by falsifying business records.   The matter has been adjourned 45 days for motions.

            DAVID L. SMITH, d/o/b 08/11/1973, of Machias, New York, but presently incarcerated in the Cattaraugus County Jail, entered a plea of guilty to Driving While Intoxicated, a class D felony, to satisfy a pending indictment.  On or about November 25, 2010, in the Town of Yorkshire the defendant operated a motor vehicle on a public highway at a time when he had a blood alcohol content level of .15%.  He will be sentenced on December 12, 2011.

            LAVELLE SOTERO, A/K/A HAWK, d/o/b 02/14/1985, address unknown, entered a plea of guilty to one count of Criminal Sale of a Controlled Substance in the Fifth Degree, a class D felony, to satisfy a pending indictment.  On July 23, 2010, in the City of Olean, he knowingly and unlawfully sold a controlled substance.   He will be sentenced on December 12, 2011.

            SHAUNA LEWIS, d/o/b 05/26/1985, of Perrysburg, New York, was sentenced to 5 years probation and assessed a mandatory State surcharge for her conviction of Criminal Sale of a Controlled Substance in the Third Degree, a class B Felony. On or about October 9, 2008, in the Town of Perrysburg, while acting jointly and in concert with another and each aiding and abetting the other, she knowingly and unlawfully sold a narcotic drug, to wit, Cocaine.


            SAMANTHA VANTUIL, d/o/b 8/18/1989, of Olean, New York, was sentenced to 5 years probation, restitution and assessed a mandatory State surcharge for her conviction of Attempted Criminal Sale of a Controlled Substance in the Fourth Degree, class D felony.   On December 16, 2010, in the City of Olean, the defendant attempted to sell Hydrocodone pills.

            ERNEST R. WALTERS, III, d/o/b 12/13/1984, of Olean, New York, was arraigned and entered a plea of not guilty in connection with an indictment handed up by a Cattaraugus County Grand Jury which charged him with Criminal Possession of a Controlled Substance in the Fifth Degree, a class D felony, and Criminal Sale of a Controlled Substance in the Fourth Degree, a class C felony.  The Indictment charged that on or about February 9, 2011, in the City of Olean, he knowingly and unlawfully possessed a controlled substance with the intent to sell it and sold a narcotic preparation.  This matter was adjourned 45 days for motions.

            BARRY E. SNYDER, III, d/o/ b 05/03/1980, of Salamanca, but presently incarcerated in the Cattaraugus County Jail, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Driving While Intoxicated, a class E felony, Aggravated Unlicensed Operation of a Motor Vehicle in the Second Degree, a misdemeanor, and Reckless Driving, a misdemeanor.  On July 3, 2011, in the City of Salamanca, he operated a motor vehicle in an intoxicated condition, without a valid driver's license due to a prior alcohol related conviction and operated his motor vehicle in a reckless manner.    Additionally, he also admitted to violating the terms and conditions of a previously imposed sentence of probation.  He will be sentenced for both matters on December 12, 2011.

            JOSEPH B. WALENKA, d/o/b 07/27/1979, of Delevan, New York, but presently incarcerated in the Cattaraugus County Jail, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Reckless Endangerment in the First Degree, a class D felony.  On June 22, 2011, in the Town of Yorkshire, under circumstances evincing a depraved indifference to human life, recklessly engaged in conduct which created a grave risk of death to another person.  He will be sentenced on December 12, 2011.



            DANIEL S. SMREK, d/o/b 05/04/1965, of Salamanca, New York, entered a plea of guilty to two counts of Driving While Intoxicated (class D felonies), and one count of Aggravated Unlicensed Operation of a Motor Vehicle in the Second Degree, a misdemeanor, to satisfy three pending indictments.  One incident occurred on March 3, 2011, in the Town of Great Valley, when the defendant operated a motor vehicle on a public highway at a time when he was in an intoxicated condition.  The second incident occurred on April 28, 2011, in the City of Salamanca, when the defendant operated a motor vehicle on a public highway at a time when he was in an intoxicated condition and without a valid driver's license because of a prior alcohol related offense.  The third incident occurred on May 7, 2011, in the City of Salamanca, when he operated a motor vehicle in an intoxicated condition.   He will be sentenced on December 12, 2011.
