Cattaraugus County court report


    Lori Pettit Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County Court on Monday, April 2, 2012:

    
     PAUL E. TYLER, JR., d/o/b 09/17/1986, of Olean, New York, but presently incarcerated in the Cattaraugus County Jail, was arraigned and entered a plea of not guilty to an indictment that charges him with two (2) counts of Grand Larceny in the Fourth Degree, class E felonies; three (3) counts of Burglary in the Second Degree, class C felonies and one (1) count of Grand Larceny in the Third Degree, a class D felony. The indictment alleges that during May 2011 in the Town of Portville, during June 2011 in the Town of Ellicottville and on or about or between June 3, 2011 and June 11, 2011 in the City of Olean, the defendant acted jointly and in concert with another individual and each aiding and abetting the other, knowingly entered and remained unlawfully in dwellings with the intent to commit a crime therein and stole property valued at more than $3,000.  The matter has been adjourned for motions. Defendant held without bail.

DESTINY BELLAUS d/o/b 05/04/1995, of Olean, New York, but presently incarcerated in the Cattaraugus County Jail, entered a plea of guilty Assault in the Second Degree, a class D felony, to satisfy a pending indictment.  The incident occurred on or about November 4, 2011 in the City of Olean, when the defendant, with the intent to cause serious physical injury to another person, caused such injury to such person.  Sentencing scheduled for July 9, 2012.

     STERLING DOCTOR, d/o/b 08/15/1990, of Gowanda, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with Burglary in the Third Degree, a class D felony; Criminal Mischief in the Third Degree, a class E felony; and Petit Larceny, a class A misdemeanor.  The indictment alleges that on or about July 13, 2011, in the Town of Persia, the defendant knowingly entered or remained unlawfully in a building with intent to commit a crime therein and stole property.  The matter has been adjourned for motions.

     YVETTE M. BRIGGS, d/o/b 10/08/1970, of Cattaraugus, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Welfare Fraud in the Fifth Degree, a class A misdemeanor; and Petit Larceny, a class A misdemeanor.  The incident occurred on or about and between June 2008 and January 2010, in the City of Olean, when the defendant committed fraudulent welfare act and thereby took or obtained public assistance benefits. Sentencing is scheduled for June 11, 2012.

BRIAN R. BENSON, d/o/b 10/31/1987, of Olean, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Promoting a Sexual Performance by a Child, a class D felony; and Possessing a Sexual Performance by a Child, a class E felony.  The incidents occurred on or about and between June 15, 2011 and October 25, 2011 in the City of Olean, when the defendant knowing the character and content thereof, produced, directed or promoted any performance which included sexual conduct by a child less than seventeen years of age.  Sentencing is scheduled for June 11, 2012.

ALEXANDER G. MADDER, d/o/b 02/08/1995, of Buffalo, New York, entered a plea of guilty to Attempted Burglary in the Third Degree, class E felony; and Petit Larceny, a class A misdemeanor, to satisfy a pending indictment.  The incident occurred on or about August 16, 2011, in the City of Olean, when the defendant knowingly attempted to enter or remain unlawfully in a building with the intent to commit a crime therein and stole property. Sentencing is scheduled for July 16, 2012.

DEVIN U. BAUER, d/o/b 11/14/1993, of Cheektowaga, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Aggravated Cruelty to Animals, a felony.  The incident occurred on or about and between August 11, 2011 and August 20, 2011, in the Town of Yorkshire, when the defendant, with no justifiable purpose, intentionally killed or intentionally caused serious physical injury to a companion animal with aggravated cruelty.  Sentencing is scheduled for July 16, 2012.

JORDAN K. FISH, d/o/b 06/09/1991, of South Dayton, New York, was sentenced to a term of 5 years probation, restitution,   150 hours of community service and assessed a mandatory State Surcharge for his conviction of Attempted Burglary in the Third Degree, a class E felony.  The incident occurred on or about November 3, 2011, in the Village of South Dayton, the defendant acted jointly and in concert with another, each aiding and abetting each other, knowingly attempted to enter or remain unlawfully in a building with the intent to commit a crime therein.
