Cattaraugus County court report

Lori Pettit Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County Court on Monday, February 27, 2012:


MICHELLE L. ROGERS, d/o/b 4/24/1980, of South Dayton, New York, was sentenced to five (5) years probation and restitution for her plea of guilty by Superior Court Information to Attempted Welfare Fraud in the Third Degree, a class E felony and three (3) years probation for her guilty plea of Offering a False Instrument for Filing in the Second Degree, a class A misdemeanor.  The incident occurred on or about and between August 2010 and May 2011, in the City of Olean, when the defendant committed a fraudulent welfare act and thereby attempted to take or obtain public assistance benefits.

JESSIE M. TARR, d/o/b 11/22/1974, of Olean, New York, was sentenced to four (4) months of weekends in the Cattaraugus County Jail and five (5) years probation for his plea of guilty by Superior Court Information to Attempted Forgery in the Second Degree, a class E felony, and three (3) years probation for his guilty plea to Petit Larceny, a class A misdemeanor.  On August 12, 2011, in the Town of Olean, with intent to defraud, deceive or injure another, he attempted to forge the signature of another person and cash a personal check in the amount of $225.

     BRENNEN D. SMITH, d/o/b 04/01/1990, of Olean, New York, but presently incarcerated in the Cattaraugus County Jail was sentenced to a term of 2 ½ years plus 1 year Post Release Supervision with the New York State Department of Corrections for his plea of guilty to one count of Attempted Criminal Sale of a Controlled Substance in the Fourth Degree, a class D felony, to satisfy a pending indictment and 1 year for his Violation of Probation to be served concurrently.  In February 2011, in the City of Olean, he attempted to sell a controlled substance. 

DANIEL S. RICHTER, d/o/b 10/12/1969, of Olean, New York, but presently incarcerated in the Cattaraugus County Jail, was sentenced to 1 year in the Cattaraugus County Jail for his plea of guilty to Assault in the Third Degree, a class A misdemeanor, to satisfy a pending indictment. On or about August 4, 2011, in the City of Olean, with intent to cause physical injury to another person, he caused physical injury to that person who was administering medical treatment to him. 

HENRY H. DONALDSON, JR., d/o/b 01/23/1974, of Olean, New York, but presently incarcerated in the Cattaraugus County Jail, was sentenced as a Predicate Felony Offender to a term of 1 ½ years plus 1 year Post Release Supervision with the New York State Department of Correction for his plea of guilty to Attempted Criminal Sale of a Controlled Substance in the Fourth Degree, class D felony, to satisfy a pending indictment.  The incident occurred on or about November 13, 2010, in the City of Olean, when he attempted to sell crack cocaine.

TANYA M. WOODS, d/o/b 06/03/1983, of Salamanca , New York,  was sentenced to five (5) years probation, $1000.00 fine and 50 hours of community service for her plea of guilty to Aggravated Driving While Intoxicated, a class E felony. On or about August 20, 2010, in the City of Salamanca, the defendant operated a motor vehicle on a public highway when she had a BAC.21%.

JOSEPH DUHAN, d/o/b 07/14/1989, of Salamanca, New York, entered a plea of guilty to Attempted Burglary in the Third Degree, a class D felony, to satisfy a pending indictment. On or about April 28, 2011, in the Town of Great Valley, the defendant acted jointly and in concert with others, and each aiding and abetting the other, knowingly entered or remained unlawfully in a building with the intent to commit a crime therein. Sentencing is scheduled to April 30, 2012.



TRAVIS J. PENROD, d/o/b 01/10/1976, of Hinsdale, New York, entered a plea of guilty to Aggravated Driving While Intoxicated, a class E felony, to satisfy a pending indictment. On or about July 17, 2011, in the Town of New Albion, the defendant operated a motor vehicle on a public highway at a time when he had a BAC .19%. Sentencing is scheduled for April 30, 2012.

JONATHAN JACKSON, d/o/b 08/25/1990, of Olean, New York, entered a plea of guilty to Burglary in the Third Degree, a class D felony and Criminal Mischief in the Fourth Degree, a class A misdemeanor to satisfy a pending indictment. On or about December 22, 2011, in the City of Olean, the defendant knowingly entered or remained unlawfully in a building with the intent to commit a crime therein. Sentencing is scheduled to April 30, 2012.

SHANE D. LUKEHART, d/o/b 11/22/1974, of Olean, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Attempted Burglary in the Third Degree, a class E felony, and Criminal Possession of Stolen Property in the Fourth Degree, a class E felony.  On March 12, 2011, in the Town of Freedom, the defendant, knowingly attempted to enter or remain unlawfully in a building with intent to commit a crime therein. He will be sentenced on May 14, 2012.


JERMAINE CRAWFORD, d/o/b 06/28/1980, of Olean, New York, but presently incarcerated in the Cattaraugus County Jail, was sentenced to a term of 1 ½ years plus 1 year Post Release   Supervision with the New York State Department of Correction to include restitution for his plea of guilty to Attempted Criminal Sale of a Controlled Substance in the Third Degree, class C felony, to satisfy a pending indictment.  The incident occurred on or about July 28, 2010, in the City of Olean, when he attempted to sell a narcotic drug.


DAVID R. DILLE, JR. d/o/b 04/29/1973, of Salamanca, New York, was sentenced as a Predicate Felony Offender to a term of 1 ½ years plus 1 year Post Release Supervision with the New York State Department of Corrections for his plea of guilty by Superior Court Information to Criminal Possession of Marijuana in the Third Degree, a class E felony.  On August 11, 2011, in the City of Salamanca, he knowingly and unlawfully possessed one or more preparations, compounds, mixtures or substances containing more than eight ounces of marijuana.
