Olean Common Council meets Tuesday...expect water and sewer billing legislation to be repealed

5.      COMMITTEE REPORTS AND UNFINISHED COUNCIL BUSINESS

Report from the Committee of the Whole on PL#01-12, to repeal Resolution #93-11, amending the water and sewer rates, pursuant to Sections 27-22(1) and 27-167(a), as follows: water rates – service fee of $5.00 per month and $0.0061 per gallon; sewer rates – service fee of $5.00 per month and $0.0061 per gallon for residential customers. Committee recommends approval. Referred to City Attorney for Resolution.

The Auditor has processed bills and claims against the City of Olean as per list submitted to each Alderman and recommends payment thereof.

whereas, the Auditor has presented to the Common Council, bills and claims against the City of Olean totaling $635,046.91 for the budget and recommends payment thereof,

now, therefore, be it resolved, that the same be and are hereby audited and allowed, and the Auditor is hereby authorized and directed to draw warrants for the payment thereof at the amounts set opposite each respective claim.

resolution rescinding resolution 93-11 amending the water and sewer billing structure and rates

whereas, that Water rates as set by the City of Olean shall from time to time in each case be as established by the common council pursuant to Chapter 27, Article II, Section 27-22(1); and

whereas, that Sewer rates as set by the City of Olean shall from time to time in each case be established by the common council pursuant to Chapter 27, Article III, Division 5, Section 27-167(A); and

whereas, the Olean Common Council approved Resolution 93-11 on December 27, 2011, amending water and sewer billing structures for residential users by charging each a $5.00 per month service fee and a rate of $0.0061 per gallon; and

whereas, on January 3, 2012, the Olean Common Council was informed that more users would be affected negatively by the new rate structure than previously anticipated.

therefore, be it resolved, that the Olean Common Council hereby rescinds Resolution 93-11 of which amended the water and sewer billing structure and rates for residential users.

it is further resolved, that this resolution shall be effective immediately.
