Cattaraugus County court


    Lori P. Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County Court on Tuesday, December 5, 2011:

     GREGORY E. FARR, d/o/b 9/3/1989, of Allegany, New York, but presently incarcerated in the Cattaraugus County Jail, was arraigned and entered a plea of not guilty to an Indictment that charges him with one count of Murder in the Second Degree, class A-I felony; one count of Manslaughter in the First Degree, a class B felony; one count of Assault in the First Degree, a class B felony and one count of Criminal Possession of a Weapon in the Fourth Degree, a class A misdemeanor. The incident occurred on or about October 24, 2011, in the Town of Allegany, when the defendant, with intent to cause the death of another person, caused the death of STEPHEN L. BALSER. The defendant is held without bail.



TIMOTHY A. GINNERY, d/o/b 4/27/1962, of Great Valley, New York, but presently incarcerated in the Cattaraugus County Jail, was arraigned and entered a plea of not guilty to an Indictment that charges him with two counts of Criminal Sale of a Controlled Substance in the Third Degree, class B felonies; two counts of Criminal Possession of a Controlled Substance in the Third Degree, a class B felonies. The incident occurred on or about December 14, 2010, in the Town of Great Valley, when the defendant knowingly and unlawfully sold a narcotic drug. The matter is adjourned for motions.


CHRISTOPHER WINSHIP, d/o/b 9/16/1984, of Olean, New York, entered a plea guilty to Attempted Criminal Sale of a Controlled Substance in the Fifth Degree, a class E felony to satisfy a pending Indictment. The incident occurred on or about April 21, 2010, in the City of Olean, when the defendant knowingly and unlawfully attempted to sell a narcotic drug. Sentencing is scheduled for February 21, 2012.

SAMMY D. GONZALES, d/o/b 10/17/1974, of Olean, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Aggravated Driving While Intoxicated, a class E felony.  The incident occurred on or about September 1, 2011, in the City of Olean, when the defendant operated a motor vehicle on a public highway at a time when he was in an intoxicated condition, having a .23% BAC. Sentencing is scheduled for February 21, 2012.

ANDREW J. GREINERT, d/o/b 8/14/1990, of Gowanda, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Driving While Intoxicated, a class E felony and Aggravated Unlicensed Operation of a Motor Vehicle in the Second Degree, a class A misdemeanor. The incident occurred on or about August 24, 2011, in the Town of Persia, when the defendant operated a motor vehicle on a public highway, having a .17% BAC, and operated a motor vehicle on a public highway when he knew or had reason to know that his license or privilege was revoked as a result of a prior alcohol related conviction. Sentencing is scheduled for February 21, 2012.

MICHELLE L. ROGERS, d/o/b 4/24/1980, of South Dayton, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Attempted Welfare Fraud in the Third Degree, a class E felony and Offering a False Instrument for Filing in the Second Degree, a class A misdemeanor.  The incident occurred on or about and between August 2010 and May 2011, in the City of Olean, when the defendant committed a fraudulent welfare act and thereby attempted to take or obtain public assistance benefits. Sentencing is scheduled for February 21, 2012.

LYNETTE M. DEER, d/o/b 4/2/1992, of Franklinville, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Forgery in the Second Degree, a class D felony.  The incident occurred on or about August 1, 2011, in the Town of Franklinville, the defendant, with intent to defraud, deceive or injure another, attempted to make, complete or alter a written instrument used in the taking or administering of drugs for which a prescription is required by law. Sentencing is scheduled for February 21, 2012.
