Cattaraugus County court report

Lori P. Rieman, Cattaraugus County District Attorney, reports the following activity in Cattaraugus County Court on Tuesday, December 12, 2011:

            BARRY K. ARMPRESTER, d/o/b 02/09/1967, of Olean, New York, entered a plea of guilty to Criminal Possession of a Controlled Substance in the Fifth Degree, a class D felony, to satisfy a pending indictment.  On or about March 24, 2011, in the City of Olean, Armprester knowingly and unlawfully possessed a controlled substance, to wit, Dihydrocodeinone with Acetaminophen, with intent to sell it.  He will be sentenced on April 23, 2012

            SUZANNE E. BARNISH, d/o/b 03/13/1965, of Allegany, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to one count of Aggravated Driving While Intoxicated, a class E felony, and one count of Aggravated Unlicensed Operation of a Motor Vehicle in the Second Degree, a misdemeanor.  On or about September 24, 2011, in the City of Olean, Barnish operated a motor vehicle on a public highway in an intoxicated condition having a .25 BAC and without a valid driver's license due to a prior alcohol conviction.   She will be sentenced on February 27, 2012.

            TIMOTHY J. HAMMOND, d/o/b 06/04/1984, of Cuba, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Driving While Intoxicated, a class E felony.   On October 8, 2011, in the City of Olean, he operated a motor vehicle on a public highway in an intoxicated condition, having a .15 BAC.   He will be sentenced on March 26, 2012.



            RICHARD D. COVERT, d/o/b 10/01/1968, of Olean, New York, entered a plea of guilty to Attempted Criminal Sale of a Controlled Substance in the Third Degree, a class C felony, to satisfy a pending indictment.  The incident occurred on or about February 5, 2011, in the City of Olean, when the defendant knowingly and unlawfully attempted to sell a narcotic drug, to wit, cocaine.  He will be sentenced on February 27, 2012.


            TIMOTHY A. GINNERY, d/o/b 4/27/1962, of Great Valley, New York, entered a plea of guilty to Attempted Criminal Sale of a Controlled Substance in the Third Degree, class C felony, to satisfy a pending indictment. The incident occurred on or about December 14, 2010, in the Town of Great Valley, when the defendant knowingly and unlawfully attempted to sell a narcotic drug, to wit, Oxycodone.  He will be sentenced on February 27, 2012.

            JESSIE M. TARR, d/o/b 11/22/1974, of Olean, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Attempted Forgery in the Second Degree, a class E felony, and Petit Larceny, a class A misdemeanor.   On August 12, 2011, in the Town of Olean, with intent to defraud, deceive or injure another, he attempted to forge the signature of another person and cash a personal check in the amount of $225.   He will be sentenced on February 27, 2012.

            DONALD I. MARSHALL, II, d/o/b 11/02/1988, address unknown, entered a plea of guilty to Attempted Criminal Sale of a Controlled Substance in the Third Degree, a class C felony, to satisfy a pending indictment.   The indictment charged that on or about March 5, 2011, in the City of Olean, he knowingly and unlawfully attempted to sell a narcotic drug, to wit, cocaine.  He will be sentenced on April 30, 2012.

            OBIDAH RAMADHAN, d/o/b 03/11/1986, of Olean, New York, entered a plea of guilty to Attempted Criminal Sale of a Controlled Substance in the Third Degree, a class C felony; to satisfy a pending indictment.  On January 1, 2011, in the City of Olean, he knowingly and unlawfully attempted to sell a narcotic drug, to wit, cocaine.  He will be sentenced February 27, 2012.

            DAVID R. DILLE, JR. d/o/b 04/29/1973, of Salamanca, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Criminal Possession of Marijuana in the Third Degree, a class E felony.  On August 11, 2011, in the City of Salamanca, he knowingly and unlawfully possessed one or more preparations, compounds, mixtures or substances containing more than eight ounces of marijuana.  He will be sentenced on February 27, 2012.

           




            MICHAEL S. LECCEARDONE, d/o/b 12/8/1973, of Salamanca, New York, was arraigned and entered a plea of guilty to Aggravated Driving While Intoxicated, a class E felony, and Aggravated Unlicensed Operation of a Motor Vehicle in the Second Degree, a misdemeanor, to satisfy a pending indictment.  On May 19, 2011, he operated a motor vehicle in an intoxicated condition, having a BAC of .20 percent and without a valid driver's license due to a prior alcohol related conviction.   He will be sentenced on March 12, 2012.
           
            DANIEL S. RICHTER, d/o/b 10/12/1969, of Olean, New York, but presently incarcerated in the Cattaraugus County Jail, entered a plea of guilty to Assault in the Third Degree, a class A misdemeanor, to satisfy a pending indictment. On or about August 4, 2011, in the City of Olean, with intent to cause physical injury to another person, he caused physical injury to that person who was administering medical treatment to him.  He will be sentenced on February 27, 2012.

            HAROLD J. GRAVES, d/o/b 5/31/1980, of Port Allegany, Pennsylvania, entered a plea of guilty to Endangering the Welfare of a Child, a class A misdemeanor, to satisfy a pending indictment.  On or about and between June 2007 and April 2009, in the Town of Hinsdale, the defendant knowingly acted in a manner likely to be injurious to the physical, mental or moral welfare of a child less than seventeen years old.  He will be sentenced on March 26, 2012.

            ALICIA M. TYGER, d/o/b 02/23/1984, of Salamanca, New York, was arraigned and entered a plea of not guilty in connection with an indictment handed up by a Cattaraugus County Grand Jury which charged her with two counts of Criminal Possession of a Controlled Substance in the Third Degree, class B felonies, and two counts of Criminal Sale of a Controlled Substance in the Third Degree, class B felonies.  The Indictment charged that December 21, 2010, in the City of Salamanca, she knowingly and unlawfully possessed and sold a narcotic drug on two separate incidents.  This matter has been adjourned 45 days for motions.








            JANDREW TERWILLIGER, d/o/b 09/12/1992, of Franklinville, New York, was arraigned and entered a plea of not guilty in connection with an indictment handed up by a Cattaraugus County Grand Jury which charged him with Burglary in the Third Degree, a class D felony; Criminal Mischief in the Second Degree, a class D felony; four counts of Making Graffiti, class A misdemeanors, and Petit Larceny, a class A misdemeanor.   The Indictment charged that on or about May 8, 2011, in the Town of Franklinville, while acting jointly and in concert with another, and each aiding and abetting each other, knowingly entered or remained unlawfully in a building with the intent to commit a crime therein, damaged property of another person in an amount exceeding one thousand five hundred dollars, made graffiti at four different locations and stole property.  This matter has been adjourned 45 days for motions.

            WAYNE IRVIN, d/o/b 05/28/1977, of Olean, New York, but presently incarcerated in the Cattaraugus County Jail, was arraigned and entered a plea of not guilty in connection with an indictment handed up by a Cattaraugus County Grand Jury which charged him with Rape in the First Degree, a class B felony; Criminal Sexual Act in the First Degree, a class B felony; Sexual Abuse in the First Degree, a class D felony, and Endangering the Welfare of a Child, a class A misdemeanor.   The Indictment charged that on or about August 15, 2011, in the City of Olean, he engaged in sexual intercourse, oral sexual conduct, sexual contact with another person less than eleven years old and knowingly acted in a manner likely to be injurious to the physical, mental or moral welfare of a child less than seventeen years old.  This matter has been adjourned 45 days for motions.

            KEITH E. SPRUCE, d/o/b 06/16/1973, of Olean, New York, was arraigned and entered a plea of not guilty in connection with an indictment handed up by a Cattaraugus County Grand Jury which charged him with seven counts of Reckless Endangerment in the First Degree, class D felonies; seven counts of Menacing in the Second Degree, class A misdemeanors, and Endangering the Welfare of a Child, a class A misdemeanor.  The indictment charged on or about May 27, 2011, in the City of Salamanca, under circumstances evincing a depraved indifference to human life, he recklessly engaged in conduct which created a grave risk of death to seven different individuals, intentionally placing or attempting to place those seven individuals in reasonable fear of physical injury by displaying a deadly weapon or dangerous instrument, and knowingly acted in a manner likely to be injurious to the physical, mental or moral welfare of a child less than seventeen years old.   This matter has been adjourned 45 days for motions.

            ANDREW J. HOFFMAN, d/o/b 07/10/1968, of Salamanca, New York, but presently incarcerated in the Cattaraugus County Jail, was arraigned and entered a plea of not guilty in connection with an indictment handed up by a Cattaraugus County Grand Jury which charged him with Aggravated Vehicular Assault in the First Degree, a class C felony; Reckless Endangerment in the First Degree, a class D felony; three counts of Assault in the Second Degree, class D felonies; Leaving Scene of personal Injury Incident, a misdemeanor, and Driving While Intoxicated, a misdemeanor.   The Indictment charged that on or about October 23, 2011, in the Town of Coldspring, he was operating a motor vehicle in an intoxicated condition, engaged in reckless driving and caused serious physical injury to three individuals and left the place where the personal injury occurred without first exhibiting his license and insurance card and his name and address to the party sustaining the injury if practical or reporting same to the nearest police station or judicial office.    This matter has been adjourned 45 days for motions.
