Cattaraugus County court report


    Lori Pettit Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County Court on Tuesday, November 22, 2011:

     JONATHAN M. NEISS, d/o/b 2/28/1983, of Olean, New York, but presently incarcerated in the Cattaraugus County Jail, was sentenced to a determinate term of two years with the NYS Department of Corrections, restitution and assessed a mandatory State surcharge for his conviction of Attempted Criminal Sale of a Controlled Substance in the Fourth Degree, a class E felony.  Additionally, he will be subject to a one year post release supervision once he is released from prison.   The incident occurred on or about December 15, 2010, in the City of Olean, when the defendant knowingly and unlawfully attempted to sell Hydrocodone pills. 



ANTHONY LICHT, d/o/b 11/21/1986, of Olean, New York, but presently incarcerated in the Cattaraugus County Jail, was sentenced to a determinate term of two years incarceration with the NYS Department of Corrections for his conviction of Criminal Sale of a Controlled Substance in the Fourth Degree, a class C felony.  Additionally, he will be subject to a term of two years post release supervision once he is released from prison.  The incident occurred on or about January 7, 2011, in the City of Olean, when the defendant knowingly and unlawfully sold Hydrocodone pills.  Also he was sentenced for his violation of probation to a term of incarceration having a minimum of one year and a maximum of three years with the NYS Department of Corrections.  This sentence is to be served concurrent to his drug conviction. 

RONALD J. HAYNOSKI, d/o/b 3/6/1981, of Portville, New York, was sentenced to a term of five years probation, his driver's license was revoked, he was fined $1,000.00 and assessed a mandatory State surcharge for his conviction of Driving While Intoxicated, a class E felony.  The incident occurred on or about May 23, 2011, in the Town of Allegany, when the defendant operated a motor vehicle in an intoxicated condition, having a .14% BAC. 

JEREMIAH L. CALKINS, d/o/b 2/14/1987, of Jamestown, New York, but presently incarcerated in the Cattaraugus County Jail, was sentenced to a term of incarceration having a minimum of one and one third years and a maximum of four years with the NYS Department of Corrections for his conviction of Rape in the Third Degree, a class E felony.  The incident occurred on or about July 17, 2011, in the Town of Yorkshire, when the defendant being 21 years old or more, engaged in sexual intercourse with another person who was less than 17 years old. 

RICHARD E. CHILDS, II, d/o/b 11/8/1985, of Olean, New York, but presently incarcerated in the Cattaraugus County Jail, was sentenced to a term of incarceration having a minimum of two years and a maximum of four years with the NYS Department of Corrections, ordered to pay restitution and assessed a mandatory State surcharge for his convictions of Burglary in the Third Degree, a class D felony and Criminal Possession of a Weapon in the Fourth Degree, a class A misdemeanor.  The first incident occurred on or about July 20, 2011, in the Town of Hinsdale, when the defendant knowingly entered or remained unlawfully in a building with intent to commit a crime therein.  The second incident occurred on or about July 24, 2011, in the Town of Hinsdale when the defendant possessed three (3) Black Daggers.

PAUL R. NEWELL, d/o/b 10/24/1975, of Steamburg, New York, was sentenced to a term of incarceration having a minimum of one year and a maximum of three years with the NYS Department of Corrections, his driver's license was revoked, he was fined $1,000.00 and assessed a mandatory State surcharge for his convictions of Aggravated Driving While Intoxicated, a class E felony and Aggravated Unlicensed Operation of a Motor Vehicle in the Second Degree, a misdemeanor.  The incident occurred on or about May 20, 2011, in the Town of Randolph, when the defendant operated a motor vehicle while he was intoxicated, having a .23% BAC and at a time his license was suspended or revoked as a result of a prior alcohol conviction.

     ROBERT W. EVANS, d/o/b 12/05/1955, of Salamanca, New York, was sentenced to a term of incarceration having a minimum of one year and a maximum of three years with the NYS Department of Corrections, his driver's license was revoked, he was fined $1,000.00 and assessed a mandatory State surcharge for his conviction of Driving While Intoxicated, a class E felony.  The incident occurred on or about February 23, 2011, in the City of Salamanca, when he operated a motor vehicle in an intoxicated condition, having a .16% BAC.  Additionally, he was sentenced to one year incarceration in the Cattaraugus County Jail for his conviction of Forcible Touching.  That incident occurred on or about September 26, 2010, in the City of Salamanca, when the defendant intentionally, and for no legitimate purpose, forcibly touched the sexual or other intimate parts of another person for the purpose of degrading or abusing such person or for the purpose of gratifying his own sexual desire.  This sentence is to run concurrent with his DWI conviction.


     RICHARD D. FARNHAM, JR., d/o/b 10/21/1978, of Salamanca, New York, but presently incarcerated in the Cattaraugus County Jail, was sentenced to a determinate term of one year incarceration with the NYS Department of Corrections, restitution and assessed a mandatory State surcharge for his conviction of Attempted Criminal Sale of a Controlled Substance in the Fifth Degree, a class E felony.  The incident occurred on or about September 20, 2010, in the City of Salamanca, when the defendant attempted to sell Xanax pills.  Additionally, he was sentenced to a term of incarceration having a minimum of one and one half years and a maximum of three years with the Department of Corrections for his conviction of Attempted Burglary in the Third Degree, a class E felony.  The incident occurred on or about April 28, 2011, in the Town of Great Valley, when Farnham, along with others, knowingly attempted to enter or remain unlawfully in a building with intent to commit a crime therein.  This sentence is to run concurrent to his drug conviction.  He will be subject to a period of one year supervision once he is released from prison.   Further, he was sentenced to a term of incarceration having a minimum of one year and a maximum of three years with the Department of Corrections for his violation of probation conviction.  This sentence is to be served consecutive to his Burglary and drug convictions.

     JOSEPH K. CARBONI, d/o/b 1/19/1981, of Albany, New York, was sentenced to a term of one year incarceration in the Cattaraugus County  Jail, his driver's license was revoked, ordered to pay fines totaling $1,000.00 and assessed a mandatory State surcharge for his convictions of Driving While Intoxicated, a class E felony, and Obstruction of Governmental Administration in the Second Degree, a class A misdemeanor.   On July 3, 2010, in the City of Salamanca, he operated a motor vehicle in an intoxicated condition and intentionally obstructed, impaired or perverted a public servant from performing an official function. 

     CHRISTOPHER SHARP, d/o/b 9/15/1971, of Arcade, New York, but presently incarcerated in the Cattaraugus County Jail, was sentenced to a term of one year incarceration in the Cattaraugus County Jail, his driver's license was revoked, he was fined $1,000.00 and assessed a mandatory State surcharge for his conviction of Driving While Intoxicated.  Additionally, he was sentenced to a term of one year incarceration on each of his convictions of Criminal Trespass in the Second Degree, Possession of Burglar Tools and Custodial Interference in the Second Degree.  These sentences are to be served concurrently to each other and current to his DWI conviction.  Further, he was sentenced to a term of 1 1/3 to 4 years in the NYS Department of Corrections for two counts of Criminal Contempt in the First Degree, E felonies, and to be served concurrent to each other and concurrent to the other charges listed above.  Additionally, he was sentenced to 1 1/3 to 4 years with the NYS Department of Corrections for a third conviction of Criminal Contempt in the First Degree, a class E felony.  This sentence is to be served consecutive to the charges listed above.
