    Lori Pettit Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County Court on Monday, March 26, 2012:

     BRADLEY M. HURLBURT, d/o/b 6/9/1973, of Weston Mills, New York, but presently incarcerated in the Cattaraugus County Jail after being extradited from South Caroline, was arraigned and entered a plea of not guilty to an indictment that charges him with Driving While Intoxicated, a class D felony; Aggravated Unlicensed Operation of a Motor Vehicle in the First Degree, a class E felony and Speed in Zone, a violation.  The indictment alleges that on or about March 13, 2011, in the Town of Great Valley, the defendant operated a motor vehicle in an intoxicated condition and at a time his license was suspended or revoked due to a prior alcohol conviction.  The matter has been adjourned for motions.

     LAWRENCE A.NADEAU, d/o/b 7/2/1977, of Gowanda, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with Grand Larceny in the Third Degree, a class E felony; Criminal Possession of Stolen Property in the Third Degree, a class D felony; and Criminal Trespass in the Third Degree, a class B misdemeanor.  The indictment alleges that on or about September 4, 2011, in the Town of Persia, the defendant stole and possessed property valued at more than $3,000.  The matter has been adjourned for motions.

     ALEXANDER G. MADDEN, d/o/b 2/8/1995, of Buffalo, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with Burglary in the Third Degree, a class D felony; and Petit Larceny, a class A misdemeanor.  The indictment alleges that on or about August 16, 2011, in the City of Olean, the defendant knowingly entered or remained unlawfully in a building with intent to commit a crime therein and stole property.  The matter has been adjourned for motions.

     GERALD D. JIMERSON, d/o/b 8/19/1974, of Salamanca, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with Strangulation in the Second Degree, a class D felony; Menacing in the Second Degree, a class A misdemeanor; Harassment in the Second Degree, a violation; Unlawful Imprisonment in the Second Degree, a class A misdemeanor; and two counts of Endangering the Welfare of a Child, class A misdemeanors.  The indictment alleges that on or about September 11, 2011, in the City of Salamanca, the defendant applied pressure on the throat or neck of another person, causing that person loss of consciousness or any other physical injury, threatened the use of a deadly weapon and engaged in a course of conduct or repeatedly committed acts which alarmed or seriously annoyed another person, all in the presence of children less than 17 years old.  The matter has been adjourned for motions.

     OBIDAH RAMADHAN, a/k/a OBI, d/o/b 3/11/1986, of Olean, New York, but presently incarcerated in the Cattaraugus County Jail, was arraigned and entered a plea of not guilty to an indictment that charges him with Criminal Possession of a Controlled Substance in the Third Degree and Criminal Sale of a Controlled Substance in the Third Degree, both class B felonies.  The indictment alleges that on or about January 25, 2012, in the City of Olean, the defendant possessed and sold a narcotic drug, to wit, crack cocaine.  The matter has been adjourned for motions.

     KEVIN L. KENNEDY, d/o/b 7/12/1988, of Olean, New York, but presently incarcerated in the Cattaraugus County Jail after being extradited from West Virginia, was arraigned and entered a plea of not guilty to an indictment that charges him with Criminal Possession of a Controlled Substance in the Fifth Degree, a class D felony; and Criminal Sale of a Controlled Substance in the Fourth Degree, a class C felony.  The indictment alleges that on or about January 7, 2011, in the City of Olean, the defendant, along with a co-defendant, knowing and unlawfully possessed and sold a narcotic preparation, to wit, Hydrocodone.

GEORGE KEECH, d/o/b 10/30/1974, of Olean, New York, was sentenced to five years probation for his conviction of Attempted Criminal Sale of a Controlled Substance in the Third Degree, a class C felony.  The incident occurred on or about November 5, 2010, in the City of Olean, the defendant knowingly and unlawfully sold a narcotic drug, to wit, crack cocaine.



     STEVEN P. HOWE, d/o/b 2/8/1975, of Delevan, New York, waived prosecution by indictment and entered a plea of guilty to Aggravated Unlicensed Operation of a Motor Vehicle in the First Degree, a class E felony; and Driving While Intoxicated, a misdemeanor.  The incident occurred on or about September 9, 2011, in the Town of Machias, when the defendant operated a motor vehicle in an intoxicated condition, having a .21% BAC and at a time his license was suspended or revoked due to a prior alcohol offense.  Sentencing is scheduled for June 4, 2012.

     CATLIN J. JACKSON, d/o/b 6/14/1984, of Salamanca, New York, entered a plea of guilty to Assault in the Third Degree and Resisting Arrest, both class A misdemeanors, to satisfy a pending indictment.  The incident occurred on or about July 15, 2011, in the City of Salamanca, when the defendant, with intent to prevent a police officer from performing his lawful duty, caused physical injury to such police officer.  Sentencing is scheduled for June 4, 2012.

     DANIEL P. KLEIN, d/o/b 8/6/1989, of Olean, New York, but presently incarcerated in the Cattaraugus County Jail, entered a plea of guilty Attempted Robbery in the Third Degree, a class E felony; and Assault in the Third Degree, a class A misdemeanor, to satisfy a pending indictment.  The first incident occurred on or about October 11, 2011, in the City of Olean, when the defendant displayed a deadly weapon or dangerous instrument and attempted to forcibly steal property.  The second incident occurred on or about October 12, 2011, in the City of Olean, when the defendant, with intent to prevent a police officer from performing a lawful duty, caused physical injury to such police officer.  Sentencing is scheduled for June 4, 2012.

     GARY MILLER, d/o/b 10/16/1953, of Salamanca, New York, entered a plea of guilty Criminal Sale of a Controlled Substance in the Fourth Degree, a class C felony, to satisfy a pending indictment.  The incident occurred on or about October 21, 2010, in the City of Salamanca, when the defendant knowingly and unlawfully sold a narcotic preparation, to wit, Hydrocodone.  Sentencing is scheduled for June 4, 2012.

     BARBARA J. ROBINSON, d/o/b 10/24/1967, of Ellicottville, New York, entered a plea of guilty to Aggravated Driving While Intoxicated, a class E felony, to satisfy a pending indictment.  The incident occurred on or about May 12, 2011, in the Village of Ellicottville, when the defendant operated a motor vehicle in an intoxicated condition, having a .34% BAC.  Sentencing is scheduled for July 9, 2012.


     DIANA L. GARDNER, d/o/b 11/9/1957, of Rochester, New York, but presenting incarcerated in the Niagara County Jail, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Attempted Forgery in the Second Degree, a class E felony; and two counts of Burglary in the Third Degree, class D felonies.  The first incident occurred on or about August 21, 2011, in the town of Allegany when the defendant attempted to forge a check.  The second incident occurred on or about August 23, 2011, in the Town of Allegany when the defendant knowing entered or remained unlawfully in a building with intent to commit a crime therein.  The third incident occurred on or about August 26, 2011, in the Town of Hinsdale, when the defendant knowingly entered or remained unlawfully in a building with intent to commit a crime therein.  Sentencing is scheduled for July 9, 2012.




Lori Pettit Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County Court on Monday, March 12, 2012:

     JAMES R. BARIBEAU, d/o/b 06/11/1990, currently incarcerated in the Cattaraugus County Jail, was sentenced to two determinate terms of 5 years incarceration with the NYS Department of Corrections in connection with two (2) counts Attempted Robbery in the First Degree, class C felonies.  The first incident occurred on September 23, 2008, in the City of Olean, while acting jointly and in concert with others and each aiding and abetting each other, he attempted to forcibly steal property and in the course of the commission of the crime or of immediate flight therefrom, displayed what appeared to be a pistol, revolver or other firearm.  The second incident occurred on October 9, 2008, in the Town of Allegany, while acting jointly and in concert with others and each aiding and abetting each other, he attempted to forcibly steal property and in the course of the commission of the crime or of immediate flight therefrom, displayed what appeared to be a pistol, revolver or other firearm.  These two terms of incarceration are to be served concurrently. Additionally, he will be subject to a 5 year term of post release supervision once he is released from prison.

     MICHAEL C. LATHROP, d/o/b 02/06/1991, of Delevan, New York, was sentenced to 5 years probation for his conviction of Attempted Robbery in the Third Degree, a class E felony.  On September 16, 2011, in the Town of Yorkshire, he attempted to forcibly steal property.

     IRA S. EVANS, d/o/b 02/04/1970, of Olean, New York, was sentenced to six months incarceration in the Cattaraugus County  Jail, five years probation, $1000.00 fine, license revocation and a mandatory State surcharge for his conviction of Aggravated Driving While Intoxicated, a class E felony.  On November 6, 2011, in the City of Olean, he operated a motor vehicle in an intoxicated condition, having a BAC of .27 percent.



    


     RACHELLE N. BARTLETT, d/o/b 06/06/1989, of Delevan, New York, was sentenced to a term of incarceration having a minimum of one year and a maximum of three years with the NYS Department of Corrections for her conviction of Attempted Assault in the Second Degree, a class E felony. The incident occurred on or about and between September 8, 2011 and September 9, 2011, in the Town of Yorkshire, being eighteen years old or more and with intent caused physical injury to a person less than seven years old, she attempted to cause such injury to such person.

     ROBERT BARNES, d/o/b 11/22/1973, of Olean, New York, was sentenced to a term of five years probation, restitution and assessed a mandatory State surcharge for his conviction of Attempted Criminal Sale of a Controlled Substance in the Fifth Degree, a class E felony, to satisfy a pending indictment.  The incident occurred on or about November 11, 2010, in the City of Olean, when he attempted to sell Xanax pills.

     MEGHAN A. KONNICK, d/o/b 12/6/1988, of Allegany, New York, was sentenced to five years probation to include the Ignition Interlock device on her vehicle, license revocation, $1,000 fine and a mandatory State surcharge for her convictions of Driving While Intoxicated, a class E felony; and Harassment in the Second Degree, a violation.  The incidents occurred on or about April 13, 2011, in the City of Olean, when the defendant operated a motor vehicle in an intoxicated condition, having a .16% BAC and with intent to harass, annoy or alarm another, she punched another person in head, neck and face.

     JESSE CONNER, d/o/b 05/27/1979, of Olean, New York, was sentenced to five years probation and a mandatory State surcharge for his conviction of Attempted Criminal Sale of a Controlled Substance , a class C felony. The incident occurred on or about March 25, 2011, in the City of Olean, when the defendant knowingly and unlawfully sold a narcotic drug, to wit, cocaine.

     MICHAEL S. LECCEARDONE, d/o/b 12/8/1973, of Salamanca, New York, was sentenced to five years probation, license revocation, fines totaling $1,500.00 and a mandatory State surcharge for his conviction of Aggravated Driving While Intoxicated, a class E felony, and Aggravated Unlicensed Operation of a Motor Vehicle in the Second Degree, a misdemeanor.  On May 19, 2011, he operated a motor vehicle in an intoxicated condition, having a BAC of .20 percent and without a valid driver's license due to a prior alcohol related conviction.



     RODNEY PEARSON, a/k/a  KIPPY, d/o/b 04/10/1971, of Olean, New York, was sentenced, as a Second Felony Offender, to a determinate term of three years with the NYS Department of Corrections for his conviction of Attempted Criminal Sale of a Controlled Substance in the Third Degree, a class C felony.   The Indictment charged that on or about June 12, 2010, in the City of Olean, defendant possessed and sold a controlled substance, to wit, cocaine.  Additionally, he will be subject to three years of post release supervision once he is release from prison.   

     JODY PETERSON, d/o/b 01/03/1975, address unknown, entered a plea of guilty to Criminal Sale of a Controlled Substance in the Fifth Degree, a class D felony, to satisfy a pending indictment. On or about February 12, 2011, in the City of Olean, he knowingly and unlawfully sold a controlled substance, to wit, cocaine.  He will be sentenced on May 14, 2012.

     SHAWN L. WELLS, d/o/b 07/05/1970, of Hinsdale, NY, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Driving While Intoxicated, a class E felony.  On or about October 6, 2011, in the Town of Hinsdale, he was operating a motor vehicle in an intoxicated condition.  He will be sentenced on May 14, 2012.

     MARK J. THOMPSON, d/o/b 01/11/1955, of Hinsdale, NY, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Aggravated Unlicensed Operation of a Motor Vehicle in the First Degree, a class E felony, and Driving While Intoxicated, a misdemeanor.  On or about August 12, 2011, in the City of Olean, he was operating a motor vehicle in an intoxicated condition and without a valid driver's due to a previous alcohol related conviction.  He will be sentenced on June 11, 2012.

     NATHAN CLESTER, d/o/b 5/27/1988, presently incarcerated in the Cattaraugus County Jail entered a plea of guilty Burglary in the Second Degree and Robbery in the Second Degree, both class C felonies, to satisfy a pending indictment.  The incident occurred on or about September 5, 2009, in the Town of Farmersville, when the defendant, while acting jointly and in concert with others, knowingly entered or remained unlawfully in a dwelling and forcibly stole property from another person.  Sentencing is scheduled for May 7, 2012.


     AARON M. RAYNOR, d/o/b 11/24/1987, of Olean, New York, entered a plea of guilty to Attempted Criminal Sale of a Controlled Substance in the Fourth Degree, a class D felony, to satisfy a pending indictment.  The incident occurred on or about January 5, 2011, in the City of Olean, when the defendant, along with a co-defendant, attempted to sell Hydrocodone pills.  Sentencing is scheduled for May 7, 2012.


     CODEY A. TINGUE, d/o/b 3/31/1985, of Delevan, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to one count of Driving While Ability Impaired by Drugs, a class E felony; and Criminal Mischief in the Fourth Degree, a class A misdemeanor.  The first incident occurred on or about April 4, 2011, in the Town of Ashford, when the defendant operated a motor vehicle when he was impaired by the use of drugs.  The second incident occurred on or about April 4, 2011, in the Town of Machias, when the defendant, having no right to do so, damaged property of another person.  Sentencing is scheduled for May 7, 2012.


PAUL A. ANDOLINA, d/o/b 3/12/1986, of Delevan, New York; was sentenced to a determinate term of two (2) years in the New York State Department of Corrections for his conviction of Attempted Burglary in the Second Degree, a class C violent felony and a concurrent term of one (1) to three (3) years for his conviction of Robbery in the Third Degree, a class D felony.  He will also be under post-release supervision for a period of three (3) years when he is released from prison.  The incident occurred on or about January 6, 2011, in the Town of Yorkshire when the defendant, along with two co-defendants, knowingly attempted to enter or remain unlawfully in a dwelling and forcibly stole property. 


RICHARD D. COVERT, d/o/b 10/01/1968, of Olean, New York, was sentenced as a Predicate Felon to a determine term of three (3) years in the New York State Department of Corrections for his conviction of Attempted Criminal Sale of a Controlled Substance in the Third Degree, a class C felony.  The incident occurred on or about February 5, 2011, in the City of Olean, when the defendant knowingly and unlawfully attempted to sell a narcotic drug, to wit, cocaine.


DOUGLAS A. FARNHAM, d/o/b 10/15/1980, of Salamanca, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with two counts of Assault in the Second Degree, class D felonies.  The indictment alleges that on or about August 7, 2011, in the City of Salamanca, the defendant, acting with others, with intent to cause serious physical injury to another person, caused such injury with a deadly weapon or dangerous instrument.  The matter has been adjourned for motions.


ANN GEORGE, d/o/b 12/11/1969 and TERRY GEORGE, d/o/b 12/9/1953, both of Franklinville, New York, were arraigned and entered a plea of not guilty to an indictment that charges them with Grand Larceny in the Third Degree, a class D felony; Welfare Fraud in the Third Degree, a class D felony; and five counts of Offering a False Instrument for File in the First Degree, class E felonies.  The indictment alleges that between September 2007 and January 2009, in Cattaraugus County, the defendant’s stole more than $3,000 by fraudulently obtaining public assistance benefits they were not entitled to.  The matters have been adjourned for motions.


MATTHEW S. REDEYE, d/o/b 10/1/1983, of Salamanca, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with Criminal Mischief in the Third Degree, a class E felony.  The indictment alleges that on or about June 27, 2011, in the City of Salamanca, the defendant, having no right to do so, damaged property of another person in an amount exceeding $250.00.  The matter has been adjourned for motions.


ROBERT J. DAY, d/o/b 6/14/1954, of Bradford, Pennsylvania, was arraigned and entered a plea of not guilty to and indictment that charges him with two counts of Driving While Intoxicated, class E felonies; Aggravated Unlicensed Operation of a Motor Vehicle in the First Degree, a class E felony; Failure to Maintain Lane and Speeding, both violations.  The indictment alleges that on or about August 19, 2011, in the Town of Farmersville, the defendant operated a motor vehicle in an intoxicated condition, having a .08% BAC and at a time when his license was suspended or revoked due to a prior alcohol related offense.  The matter has been adjourned for motions.


ANGELO A. CONTRERAZ, d/o/b 6/14/1994, of Salamanca, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with three counts of Burglary in the Third Degree, class D felonies; Grand Larceny in the Fourth Degree, a class E felony; two counts of Petit Larceny, class A misdemeanors; and two counts of Criminal Possession of Stolen Property in the Fifth Degree, class A misdemeanors.  The indictment alleges that during late May 2011, in the City of Salamanca, the defendant, along with co-defendants, knowingly entered or remained unlawfully in buildings with intent to commit crimes therein and stole property.  The matter has been adjourned for motions.

PISCITELLI, d/o/b 4/4/1992, of Salamanca, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with Burglary in the Third Degree, a class D felony; Petit Larceny, a class A misdemeanor; Criminal Possession of Stolen Property in the Fifth Degree, a class A misdemeanor.  The indictment alleges that during late May 2011, in the City of Salamanca, the defendant, along with co-defendants, knowingly entered or remained unlawfully in a building with intent to commit a crime therein and stole property.  The matter has been adjourned for motions.

MICHELLE L. ROGERS, d/o/b 4/24/1980, of South Dayton, New York, was sentenced to five (5) years probation and restitution for her plea of guilty by Superior Court Information to Attempted Welfare Fraud in the Third Degree, a class E felony and three (3) years probation for her guilty plea of Offering a False Instrument for Filing in the Second Degree, a class A misdemeanor.  The incident occurred on or about and between August 2010 and May 2011, in the City of Olean, when the defendant committed a fraudulent welfare act and thereby attempted to take or obtain public assistance benefits.

JESSIE M. TARR, d/o/b 11/22/1974, of Olean, New York, was sentenced to four (4) months of weekends in the Cattaraugus County Jail and five (5) years probation for his plea of guilty by Superior Court Information to Attempted Forgery in the Second Degree, a class E felony, and three (3) years probation for his guilty plea to Petit Larceny, a class A misdemeanor.  On August 12, 2011, in the Town of Olean, with intent to defraud, deceive or injure another, he attempted to forge the signature of another person and cash a personal check in the amount of $225.

     BRENNEN D. SMITH, d/o/b 04/01/1990, of Olean, New York, but presently incarcerated in the Cattaraugus County Jail was sentenced to a term of 2 ½ years plus 1 year Post Release Supervision with the New York State Department of Corrections for his plea of guilty to one count of Attempted Criminal Sale of a Controlled Substance in the Fourth Degree, a class D felony, to satisfy a pending indictment and 1 year for his Violation of Probation to be served concurrently.  In February 2011, in the City of Olean, he attempted to sell a controlled substance. 

DANIEL S. RICHTER, d/o/b 10/12/1969, of Olean, New York, but presently incarcerated in the Cattaraugus County Jail, was sentenced to 1 year in the Cattaraugus County Jail for his plea of guilty to Assault in the Third Degree, a class A misdemeanor, to satisfy a pending indictment. On or about August 4, 2011, in the City of Olean, with intent to cause physical injury to another person, he caused physical injury to that person who was administering medical treatment to him. 

HENRY H. DONALDSON, JR., d/o/b 01/23/1974, of Olean, New York, but presently incarcerated in the Cattaraugus County Jail, was sentenced as a Predicate Felony Offender to a term of 1 ½ years plus 1 year Post Release Supervision with the New York State Department of Correction for his plea of guilty to Attempted Criminal Sale of a Controlled Substance in the Fourth Degree, class D felony, to satisfy a pending indictment.  The incident occurred on or about November 13, 2010, in the City of Olean, when he attempted to sell crack cocaine.

TANYA M. WOODS, d/o/b 06/03/1983, of Salamanca , New York,  was sentenced to five (5) years probation, $1000.00 fine and 50 hours of community service for her plea of guilty to Aggravated Driving While Intoxicated, a class E felony. On or about August 20, 2010, in the City of Salamanca, the defendant operated a motor vehicle on a public highway when she had a BAC.21%.

JOSEPH DUHAN, d/o/b 07/14/1989, of Salamanca, New York, entered a plea of guilty to Attempted Burglary in the Third Degree, a class D felony, to satisfy a pending indictment. On or about April 28, 2011, in the Town of Great Valley, the defendant acted jointly and in concert with others, and each aiding and abetting the other, knowingly entered or remained unlawfully in a building with the intent to commit a crime therein. Sentencing is scheduled to April 30, 2012.



TRAVIS J. PENROD, d/o/b 01/10/1976, of Hinsdale, New York, entered a plea of guilty to Aggravated Driving While Intoxicated, a class E felony, to satisfy a pending indictment. On or about July 17, 2011, in the Town of New Albion, the defendant operated a motor vehicle on a public highway at a time when he had a BAC .19%. Sentencing is scheduled for April 30, 2012.

JONATHAN JACKSON, d/o/b 08/25/1990, of Olean, New York, entered a plea of guilty to Burglary in the Third Degree, a class D felony and Criminal Mischief in the Fourth Degree, a class A misdemeanor to satisfy a pending indictment. On or about December 22, 2011, in the City of Olean, the defendant knowingly entered or remained unlawfully in a building with the intent to commit a crime therein. Sentencing is scheduled to April 30, 2012.

SHANE D. LUKEHART, d/o/b 11/22/1974, of Olean, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Attempted Burglary in the Third Degree, a class E felony, and Criminal Possession of Stolen Property in the Fourth Degree, a class E felony.  On March 12, 2011, in the Town of Freedom, the defendant, knowingly attempted to enter or remain unlawfully in a building with intent to commit a crime therein. He will be sentenced on May 14, 2012.


JERMAINE CRAWFORD, d/o/b 06/28/1980, of Olean, New York, but presently incarcerated in the Cattaraugus County Jail, was sentenced to a term of 1 ½ years plus 1 year Post Release   Supervision with the New York State Department of Correction to include restitution for his plea of guilty to Attempted Criminal Sale of a Controlled Substance in the Third Degree, class C felony, to satisfy a pending indictment.  The incident occurred on or about July 28, 2010, in the City of Olean, when he attempted to sell a narcotic drug.


DAVID R. DILLE, JR. d/o/b 04/29/1973, of Salamanca, New York, was sentenced as a Predicate Felony Offender to a term of 1 ½ years plus 1 year Post Release Supervision with the New York State Department of Corrections for his plea of guilty by Superior Court Information to Criminal Possession of Marijuana in the Third Degree, a class E felony.  On August 11, 2011, in the City of Salamanca, he knowingly and unlawfully possessed one or more preparations, compounds, mixtures or substances containing more than eight ounces of marijuana. 







Lori Pettit Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County Court on Tuesday February 21, 2012:

ANDREW J. GREINERT, d/o/b 8/14/1990, of Gowanda, New York, was sentenced to a term of incarceration having a minimum of one year and a maximum of three years with the NYS Department of Corrections, fines totaling $1,500.00, license revocation and a mandatory State surcharge for his convictions of Driving While Intoxicated, a class E felony and Aggravated Unlicensed Operation of a Motor Vehicle in the Second Degree, a class A misdemeanor. Further, he will have a period of Interlock Supervision to follow his release from prison.  The incident occurred on or about August 24, 2011, in the Town of Persia, when the defendant operated a motor vehicle on a public highway, having a .17% BAC, and operated a motor vehicle on a public highway when he knew or had reason to know that his license or privilege was revoked as a result of a prior alcohol related conviction.  Additionally, he was sentenced to a term of incarceration having a minimum of one year and a maximum of three years with the NYS DOC to run concurrently to his DWI conviction for violating the terms and conditions of a previously imposed sentence of probation.

     SAMMY D. GONZALES, d/o/b 10/17/1974, of Olean, New York, was sentenced to five (5) years probation, license revocation, fines totaling $1,000.00 and a mandatory State surcharge for his conviction of Aggravated Driving While Intoxicated, a class E felony.  The incident occurred on or about September 1, 2011, in the City of Olean, when the defendant operated a motor vehicle on a public highway at a time when he was in an intoxicated condition, having a .23% BAC.


    


     LYNETTE M. DEER, d/o/b 4/2/1992, of Franklinville, New York, was sentenced to five (5) years probation and assessed a mandatory State surcharge for her conviction of Forgery in the Second Degree, a class D felony.  The incident occurred on or about August 1, 2011, in the Town of Franklinville, when the defendant, with intent to defraud, deceive or injure another, attempted to make, complete or alter a written instrument used in the taking or administering of drugs for which a prescription is required by law.

     KAREN M. FRIES, d/o/b 11/30/1971, of Allegany, New York, was sentenced to five (5) years probation, restitution and assessed a mandatory State surcharge for her conviction of Attempted Criminal Sale of a Controlled Substance in the Third Degree, a class C felony.  The incident occurred on or about May 26, 2010, in the City of Olean, when the defendant knowingly and unlawfully attempted to sell crack cocaine. 

     DAVID J. VATTES, d/o/b 8/4/1976, of Olean, New York, was sentenced to five (5) years probation, restitution and assessed a mandatory State surcharge for his conviction of Attempted Criminal Sale of a Controlled Substance in the Fourth Degree, class D felony.  The incident occurred on or about March 17, 2011, in the City of Olean, when the defendant knowingly and unlawfully sold a narcotic preparation.

     ALICIA M. TYGER, d/o/b 02/23/1984, of Salamanca, New York, entered a plea of guilty to Attempted Criminal Sale of a Controlled Substance in the Third Degree, a class C felony.  The Indictment charged that December 21, 2010, in the City of Salamanca, she knowingly and unlawfully attempted to sell a narcotic drug, to wit, Oxycodone.

     TRAVIS GILBERT, d/o/b 9/13/1988, of Salamanca, New York, plead guilty to Attempted Burglary in the Third Degree, a class E felony, to satisfy a pending indictment.  On or about April 28, 2011, in the Town of Great Valley, while acting jointly and in concert with another, knowingly attempted to enter or remain unlawfully in a dwelling with intent to commit a crime therein.  He will be sentenced on May 14, 2012.






     JANDREW TERWILLIGER, d/o/b 09/12/1992, of Franklinville, New York, entered a plea of guilty Attempted Burglary in the Third Degree, a class E felony, to satisfy a pending indictment.   On or about May 8, 2011, in the Town of Franklinville, while acting jointly and in concert with another, knowingly attempted to enter or remain unlawfully in a building with the intent to commit a crime therein.  He will be sentenced on April 23, 2012.

     LISA M. WISNIEWSKI, d/o/b 02/26/1971, address unknown but presently incarcerated in the Erie County Holding Center, Buffalo, New York, was arraigned and entered a plea of guilty to Grand Larceny in the Fourth Degree, a class E felony, and Attempted Identity Theft in the First Degree, a class E felony.  Between June 4, 2011 and July 1, 2011, in the Town of Ellicottville, she knowingly and with intent to defraud, assumed the identity of another person by using that person's personal identifying information and did steal property with a value exceeding $3,000. She will be sentenced on June 4, 2012.

     DOUGLAS REED, d/o/b 1/10/1984, of Great Valley, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Attempted Burglary in the Third Degree, a class E felony.  On or about April 28, 2011, in the Town of Great Valley, while acting jointly and in concert with others, knowingly attempted to enter or remain unlawfully in a building with intent to commit a crime therein.  He will be sentenced on May 21, 2012.

     MARK A. HARMON, d/o/b 01/05/1966, of Olean, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Driving While Intoxicated, a class E felony.  On or about October 22, 2011, in the City of Olean, he operated a motor vehicle in an intoxicated condition, having a BAC of .16 percent.   He will be sentenced on April 23, 2012.

     CRAIG M. SIMON, d/o/b 8/13/1971, of Olean, New York, was arraigned and entered a plea of not guilty in connection to an indictment handed up by a Cattaraugus County Grand Jury which charged him with two counts of Driving While Intoxicated, class E felonies.  The indictment charged that on or about August 13, 2011, in the City of Olean, he was operating a motor vehicle in an intoxicated condition, having a BAC of .16 percent.  This matter has been adjourned 45 days for motions.
 



     ZACKARY R. RICHARDSON, d/o/b 12/12/1992, of Killbuck, New York, was arraigned and entered a plea of not guilty in connection to an indictment handed up by a Cattaraugus County Grand Jury which charged him with two counts of Rape in the Second Degree, class D felonies.  The indictment charged that on or about April 30, 2011, in the Town of Great Valley, being eighteen years old or more, he engaged in sexual intercourse with another person less than fifteen years old.  This matter has been adjourned 45 days for motions.

     ALLEN LARKIN, JR., d/o/b 11/13/1987, of Salamanca, New York, but presently incarcerated in the Cattaraugus County Jail, was arraigned and entered a plea of not guilty in connection to an indictment handed up by a Cattaraugus County Grand Jury which charged him with Attempted Murder in the Second Degree, a class B-violent felony; Assault in the Second Degree, a class D felony; Menacing in the Second Degree, a class A misdemeanor; Criminal Possession of a Weapon in the Fourth Degree, a class A misdemeanor, and Reckless Endangerment in the First Degree, a class D felony.  The Indictment charged that on or about December 11, 2011, in the City of Salamanca, with intent to cause the death of another person, he attempted to cause the death of such person and caused physical injury to such person by means of a deadly weapon.  By his actions he intentionally placed or attempted to place such person in reasonable fear of physical injury by displaying a dangerous instrument and recklessly engaged in conduct which created a grave risk of death to such person.  This matter has been adjourned 45 days for motions.
